The National Guard, with approval from a state's governor, can detain individuals, but the other branches of the military can offer mostly logistical support. WHAT WE FOUND A president has the executive power to deploy the military to assist with immigration enforcement, but there are legal limits on the role the military can play. The Posse Comitatus Act, a 143-year-old law, prohibits the president from using active-duty, full-time service members, such as soldiers or Marines, as a police force, according to the Brennan Center for Justice . That means federal military branches like the U.S. Army or Air Force can’t perform tasks such as detaining individuals or making arrests on U.S. soil, even under a national emergency declaration. David Bier, director of immigration studies at the Cato Institute, explained that active-duty service members, barred from acting like police under Posse Comitatus, would likely focus on non-law enforcement tasks. That could include building infrastructure, like temporary detention facilities, transporting detainees and providing armed backup for domestic law enforcement. The Posse Comitatus Act, however, does not apply to the National Guard, Peter Margulies, a law professor at Roger Williams University, told VERIFY. “The National Guard is a state militia and can be called out by the president with the cooperation of the state governors, and so you could have the National Guard from, let's say, Texas, be used for apprehension. That would not create Posse Comitatus issues,” Margulies said. Trump's post on Truth Social mentioned declaring a national emergency, but the president can request National Guard assistance or federal military assistance with or without declaring a national emergency , according to Chris Mirasola, a contributor for non-profit Lawfare. The Brennan Center for Justice explains that declaring a national emergency grants a president with swift authority during times of crises without waiting for Congressional approval, including diverting federal funds or resources. Both Bier and Margulies told VERIFY Trump's deportation agenda would likely face significant legal challenges and be subject to congressional oversight. And if he declares a national emergency, Congress has the ability to eventually terminate that declaration , but it would require passing a law with a veto-proof supermajority, “which is increasingly difficult in our polarized political environment,” Goitein told VERIFY. Military involvement in immigration enforcement is not unprecedented. In 2019, then-President Trump declared a national emergency to redirect military funds to construct the U.S.-Mexico border wall. More recently, President Joe Biden used a national emergency declaration to deploy the National Guard to the southern border to assist with processing and facility operations tied to drug enforcement. According to Google Trends data , online searches about mass deportation have spiked, with some appearing to link the military's involvement to martial law. Martial law involves the suspension of ordinary law and government functions, with military authorities assuming control. Margulies said even if Trump uses the military in his administration’s deportation efforts, it would not equate to declaring martial law. Margulies explained that martial law hasn’t been used since the Civil War and is “profoundly unlikely” to happen as part of Trump’s proposed initiative because he doesn’t need martial law to execute his deportation plans. Unveils Firestop Clash Management and Locator UpdatesIt’s as good a time as any to take a broader look at the Philadelphia Flyers , who hit the 20-game mark (10 at home, 10 on the road) with a somewhat disappointing 8-10-2 record and in sixth place in the Metropolitan Division, which has already seemed to separate itself into four teams that can contend for a Stanley Cup, and four that are either rebuilding or have real issues. Advertisement Let’s get right to it. The two longtime pals have simply been the Flyers’ two best players this season. Travis Sanheim has anchored the defense group, which has endured a number of early-season injuries, while Travis Konecny has been the most consistent and dangerous forward. Sanheim is probably the Flyers’ MVP at the quarter point, contributing at both ends of the ice and playing the best hockey of his career. He’s a plus-2 on a team that’s been outscored by 17 at five-on-five. He’s third in the league in ice time with 25:33 per game, despite getting hardly any power-play time. Prior to Wednesday’s game, Sanheim eclipsed 30 minutes in three of the Flyers’ previous five games as the team continues to wait for others to get back into the lineup. All 12 of Sanheim’s points have come at even strength, putting him just one behind league co-leaders Alex Pietrangelo, Cale Makar and Owen Power. It was notable that when Rod Brind’Amour was asked before Wednesday’s game what the Flyers were doing differently from the last time they faced the Hurricanes just two weeks ago, he told reporters: “Sanheim is in the rush every play, like an old Bobby Orr back there from back in the day, which is fun to watch. ... So, we’ve got to be aware of that guy.” Konecny remains the heartbeat of the team and is on a path toward his best season yet. He’s averaging more than a point per game (23 in 20 games), is on pace for 45 goals (11 so far), and is the Flyers’ team leader with five power-play goals. We’ll see how his eight-year contract that kicks in next season ages over time, but Konecny sure isn’t slowing down. Just the opposite. While Konecny is pulling his weight, and Matvei Michkov is still producing through some inevitable rookie growing pains, every one of the other scoring forwards has been disappointing so far. Owen Tippett, Joel Farabee, Tyson Foerster and Bobby Brink, four young wingers with upside that the organization was hoping would take another step, have just 14 goals in a combined 76 games. Advertisement There have been some signs that they’re all working their way out of early season slumps: Three of Tippett’s four goals have come this month and he’s had the puck on his stick more often, Farabee has had a number of scoring chances lately and has been on the receiving end of some compliments from John Tortorella, and Foerster is starting to get back to playing hard along the wall and winning his battles, which he wasn’t doing much of earlier (a demotion to the fourth line seems to have gotten his attention). But the overall consistency from this group hasn’t been there. Yes, the power play has hit a bit of a snag lately, going just 2-for-20 in the last seven games. But losing both quarterbacks in Jamie Drysdale and Emil Andrae has predictably thrown it off course, while other players have been shuffled in and out of the two units lately, too. The Flyers sit 20th in the NHL in power-play percentage (16.9 percent), which is still more than three percentage points higher than they averaged from 2021-22 through last season. Once they get all their pieces back, and assuming Michkov becomes a more dangerous threat offensively as the season moves along, they could very well end up in the top half of the league. The penalty kill has simply picked up where it left off last season, sitting in fourth place in the league at 86.6 percent. The Flyers have just one short-handed goal, but are still getting chances the other way: According to Natural Stat Trick, they are generating 9.69 scoring chances per 60 minutes on the penalty kill, third in the league. The good news on Wednesday is that Ryan Poehling’s shot from distance beat Pyotr Kochetkov in the second period, tying the game at 1-1. It was Poehling’s first goal of the season, and just the second from a Flyers center since Oct. 26 (Morgan Frost had the other on Nov. 5). Advertisement The bad news is that Poehling’s turnover later in the game helped to generate what turned out to be the game-winning goal, while Scott Laughton’s misplay early in the first period that Carolina also capitalized on earned the alternate captain some lengthy time on the bench. The Flyers just don’t have a high-end, play-driving center on the roster, while the guy that has the best chance to develop into one, Frost, has been a healthy scratch for four of the last five games. Is it time yet for general manager Daniel Briere to get a little aggressive to try and find one? Is it worth circling back to the Ducks to gauge interest in and maybe even take a chance on Trevor Zegras, perhaps? Zegras is only signed through next season, so even if the Flyers acquired him they wouldn’t be committed to him long term. It just feels like it’s time for Briere to try something different here. It was unfortunate timing for Andrae when he got hurt late in last Saturday’s win over the Sabres , as he was earning big minutes and showing that he might be ready to stick around the NHL full-time. Fortunately for him and the team, Andrae was on the ice on Wednesday, suggesting he could be back soon. He’s second on the Flyers in expected-goals share (55.6 percent), but just watching him (and speaking with him) it was becoming evident that he has a growing confidence with and without the puck. Frankly, Andrae is turning into the player that the Flyers were hoping Drysdale (1 goal, 2 assists in 15 games) would become. It’s much, much too early to write off Drysdale, who it seems was rushed into the NHL by the Ducks which may have stunted his development. But he’s going to be under the microscope when he returns from his upper-body injury, because the Flyers may not want to dress all of Andrae, York and Drysdale in the same games for fear of being too small on their back end (for his part, Tortorella said he’s not afraid of doing this, when asked a week ago. We’ll see.) Don’t blame Ersson for the Flyers being fourth from the bottom of the league in goals-against average (3.50) through Wednesday’s games. The Flyers’ No. 1 goalie has been generally solid all season, with a 2.70 GAA and .902 save percentage in 11 games. He just seemed to be hitting his stride, too, before coming out of the lineup with what’s believed to be a groin injury : in his last five appearances, Ersson stopped 109 of 116 shots for a .940 save percentage in 257 minutes, with a 3-0-1 mark. Both Ersson and Tortorella mentioned early in the season when the goalie’s stat line wasn’t so hot that they believed he was playing better than the numbers suggested. That proved to be the case, because when the Flyers finally got some structure back in their game, Ersson was outstanding. Advertisement The 25-year-old still has an outside chance to make Team Sweden for the upcoming 4 Nations tournament, although Minnesota ’s Filip Gustavsson is probably the odds-on favorite to be the No. 3 there behind Jacob Markstrom and Linus Ullmark. But, considering his injury has occurred twice in a short period of time, he may be better off sitting it out anyway. The Flyers need him healthy if they’re going to have any chance at hanging around the playoff race due to their mishandling of the backup goalie position (see below). Yes, they’ve been a bit better lately, but there’s still a tremendous amount of uncertainty with both Ivan Fedotov and Aleksei Kolosov. It’s not a stretch to suggest that neither of them would be on any other NHL team’s roster at the moment. Their combined numbers are awful: 3-8-0, with an .874 save percentage and 3.70 goals-against average. Their numbers are nearly identical (Fedotov’s .875 save percentage is slightly better than Kolosov’s .872, while his GAA of 3.69 is also just a tad better than Kolosov’s 3.71). Cal Petersen seems to be an afterthought in the organization at the moment, but he would have done better than that. If there’s reason for hope it probably lies more with Fedotov, who won three straight starts and looked to be settling in before he allowed a backbreaking soft third-period goal on Wednesday in the Flyers’ 4-1 loss to Carolina. He made some decent saves before that — his stop on Jack Roslovic in the first period on a two-on-none break seemed to give the Flyers energy at the time — but his overall body of work this season has still been subpar. Kolosov should return to the AHL when Ersson recovers. It’s not fair to Fedotov to have to share the net with him, and it’s not a good message to other players currently on the Phantoms who are working hard to make the leap, either. You will recall that in 2023, around this time, Plateau State was in mourning. “The President has been deeply concerned, and now we’ve been able to celebrate Christmas with relative peace, moving towards the New Year,” Mr Mutfwang said. The governor noted that the security situation in the state had improved significantly this year compared to last, due to the efforts of the security forces. “The security forces are on the ground and doing their best. “We have also invested heavily in technology and mobilised our communities,’’ he said. 'Failure is not an option': Fire-torn Jasper entering new year with hope and anxietyNEW YORK — After Hassan Naveed, City Hall’s former hate crimes prevention director, was fired earlier this year , he alleged his axing was the result of religious-based workplace discrimination and said he would take legal action against Mayor Adams’ administration over the matter. A notice of claim filed by Naveed reveals he also plans to take legal action directly against Adams over allegations that the mayor defamed and retaliated against him in the aftermath of his termination. Naveed’s notice, filed in July, marks the first formal step in his planned lawsuit against the city and charges Adams made the “false and defamatory” comments about him during an April 30 press conference at City Hall. “When asked why [Naveed] was terminated, Mayor Adams stated, along the lines of, ‘you’re given a responsibility in a role, you’re in charge of hate crimes. I’m seeing an increase in hate crimes,’ and ‘people have to live up to what they’re hired to do, taxpayers deserve that,'” states the notice, a copy of which was obtained by the Daily News via a Freedom of Information Law request. “Mayor Adams made such statements with the personal knowledge that they were false and harmful to plaintiff’s reputation, but stated them publicly anyway in retaliation and to punish [Naveed], such that [Naveed] may not receive a job in the future.” The notice, which has never previously been reported, specifies Naveed’s lawsuit will allege “defamation of character” and “retaliation,” in addition to wrongful termination and violations of his freedom of religion. Naveed is Muslim and said upon his April 18 sacking that he had “definitely been fired because” of his faith, as first reported by The News. In response to his defamation accusations, Adams spokeswoman Kayla Mamelak said Wednesday that Naveed is the one making “false” comments. “This individual was an at-will employee who, after being terminated, went to the press and made false statements about why he was let go. The press then asked Mayor Adams for his explanation and he responded with the truth,” Mamelak said. “The mayor has every right to set the record straight when false claims are made about the administration.” In an interview with The News this week, Naveed elaborated on his notice’s defamation claim, saying Adams’ April 30 remarks about him were contradicted by his City Hall job performance reviews, which he claimed gave him positive grades. “And the idea that occasional fluctuations in hate crime data shows success is superficial,” Naveed said. “We are supposed to look at things from a much larger perspective, beyond politics.” At the time Naveed was canned, hate crime rates were spiking in the city following the outbreak of the Israel-Hamas war, with the NYPD receiving 136 hate crime complaints and conducting 76 hate crime-related arrests in the first quarter of 2024. Those rates have since increased further, with 153 complaints and 79 arrests logged by the NYPD in the third quarter of 2024. In addition to his performance reviews, Naveed said he sent emails while at City Hall urging then-Deputy Mayor for Public Safety Phil Banks’ office to allocate more resources for Naveed’s team amid the city’s early 2024 hate crime uptick. Those requests went unfulfilled, according to Naveed. In April, Mamelak, Adams’ spokeswoman, said Naveed was let go because “it was determined that the important mission of this office should be led by someone who puts bringing hate crimes down first and themself second.” Naveed’s position hasn’t been filled nearly eight months later. Naveed’s former deputy, Eunice Lee, the only other staffer in the hate crimes prevention office, resigned in July , and her role hasn’t been filled either. Mamelak said City Hall is in the process of “onboarding” a new executive director to replace Naveed, but didn’t offer a timeline for when a hire will be made. Trump urges Supreme Court to delay TikTok decision until he takes officeThen another thought crossed his mind: It was the Patriots who were coming to town this Sunday for the first time since the injury. “Yeah, it’s a little weird,” Murray said with a wry grin. "I will try not to have that happen again.” The injury on Dec. 12, 2022, cost Murray roughly 11 months of his career, but he has been healthy this season. And now the Cardinals (6-7) are clinging to playoff hopes when they host the Patriots (3-10) on Sunday. Both teams have lost three straight games. The Patriots are coming off their bye week and haven't played since a 25-24 loss to the Indianapolis Colts on Dec. 1. The Cardinals are trying to move past a brutal 30-18 loss to NFC West rival Seattle which knocked them into a tie for last place in the tightly packed division. Murray is coming off one of his worst games since the injury, throwing two interceptions that each eventually lead to touchdowns for Seattle. It was a rare blemish on an otherwise solid season — he has thrown for 2,862 yards, 15 touchdowns and eight interceptions. Now the Cardinals are pretty much in must-win territory. “For us, all we can do is control what we can control and that’s this weekend,” Murray said. "Today, tomorrow, go out there on Sunday and play good football.” The Cardinals' defense needs a better performance after giving up 409 total yards to Seattle last week, including 176 yards on the ground. Tightening against the run game is particularly important against New England's rookie quarterback Drake Maye, who's averaging 9.1 yards per rush on 38 attempts. The highest rushing average for an NFL quarterback in a single season is 8.5 by Michael Vick in 2006, when he had 123 rushing attempts for 1,039 yards with Atlanta. Maye's far from one-dimensional. Addressing a press conference here, he said the PTI tried to sink the country’s economy. “PTI launched a third onslaught on the Centre which was thwarted.” Rubbishing the PTI’s claim about causalities at the hands of law enforcers, the minister said: “Security personnel were martyred during the PTI’s protest but found no evidence of any citizen’s death.” He said: “The KP government attacked Centre with [official] weapons and equipment.” He advised the provincial government to focus on the law and order situation in the province in general and in Parachinar in particular. Separately, Federal Information Minister Attaullah Tarar said on Saturday the state had decided that all ‘miscreants’ involved in the recent violent protests would be tried speedily and severe punishments would be awarded to them. He told a news conference in Rawalpindi and said in a statement issued earlier that the state had decided that no one would be given concessions, so that an example could be set for future. Britain should follow Australia’s lead and ban young people from social media, according to a leading campaigner for the protection of childhood. The Australian Parliament last week backed the world’s toughest measures to stop under-16s using social media – and tech companies could fines of nearly £26million if they do not enforce new rules. Former Conservative MP Miriam Cates, a senior fellow at the Centre for Social Justice and GB News presenter, hopes Australia will blaze a trail for Britain to follow. She wants children denied access to “dreadful” content which encourages suicide, self-harm and misogyny and exposes them to pornography – and she is concerned they can be “contacted by people they don’t know” and “bullied by people they do know”. Ms Cates is also alarmed that algorithms encourage young people to spend hours staring at screens. “They are not being outside, they are not making face to face contact, they are not reading, they are not studying they are not doing sport – all those things that children really need to grow into competent adults,” she said. A further goal is encouraging smartphone manufacturers to produce phones which allow children to make calls, send texts, use digital train tickets and access maps – but not download apps. “I think that’s the answer really but Government will have to incentivise that to make it happen,” she said. Her call comes as Labour MP Josh MacAlister works to change the law so headteachers will have a legal requirement to make schools “mobile-free zones”. His draft law would raise the age of “internet adulthood” from 13 to 16 – making it harder for companies to use children’s data to “push addictive content”.
