WASHINGTON — President Joe Biden had long pledged that he would not pardon his son, Hunter, who was set to be sentenced this month for gun and tax convictions. But on Sunday, the president did it anyway. The sweeping pardon covers not only Hunter Biden’s convictions in two cases in Delaware and California, but also any other “offenses against the United States which he has committed or may have committed or taken part in during the period from January 1, 2014 through December 1, 2024.” Biden is hardly the first president to deploy his pardon powers to benefit those close to him. But it was still a surprising reversal for a man who pledged to restore norms and respect for the rule of law. The U.S. Constitution says that a president has the power to grant clemency, which includes both pardons and commutations. A pardon forgives federal criminal offenses; a commutation reduces penalties but isn’t as sweeping. The power has its roots in English law — the king could grant mercy to anyone — and it made it over the ocean to the American colonies and stuck around. The U.S. Supreme Court has found the presidential pardon authority to be very broad. And presidents use the power a lot: Donald Trump granted 237 acts of clemency during his four years in office and Barack Obama granted clemency 1,927 times in his eight years. Presidents have forgiven drug offenses, fraud convictions and Vietnam-era draft dodgers, among many other things. But a president can only grant pardons for federal offenses, not state ones. Impeachment convictions also aren’t pardonable. Hunter Biden was convicted in June of lying on a federal form when he purchased a gun in 2018 and swore that he wasn’t a drug user. Just months later, he pleaded guilty to charges accusing him of a scheme to avoid paying at least $1.4 million in taxes. Prosecutors alleged he lived lavishly while flouting the tax law, spending his cash on things like strippers and luxury hotels — “in short, everything but his taxes.” Both cases stemmed from a period in Hunter Biden’s life in which he struggled with drug and alcohol abuse before becoming sober in 2019. After the gun trial aired salacious and unflattering details about Hunter Biden’s life, the president’s son said he agreed to plead guilty to the tax charges to spare his family another embarrassing criminal trial. The tax trial was also expected to showcase details about Hunter Biden’s foreign business dealings, which Republicans have seized on to try to paint the Biden family as corrupt. Hunter Biden was supposed to be sentenced this month in the two cases by judges in California and Delaware who were nominated to the bench by Trump. Special counsel David Weiss’ office had not said whether prosecutors had planned to seek prison time. The tax charges carried up to 17 years behind bars and the gun charges were punishable by up to 25 years in prison, though federal sentencing guidelines were expected to call for far less time and it was possible the younger Biden would have avoided prison time entirely. Yes. Hunter Biden has been under federal investigation since 2020. He reached a deal with federal prosecutors and was supposed to plead guilty last year to misdemeanor tax offenses and would have avoided prosecution in the gun case as long he stayed out of trouble for two years. But the plea hearing quickly unraveled when the judge raised concerns about unusual aspects of the deal. He was subsequently indicted in the two cases, and he’s claimed that he was singled out because he is the president’s son. The president told reporters earlier this summer that he would not pardon his son. “I’m extremely proud of my son Hunter. He has overcome an addiction. He is one of the brightest, most decent men I know,” he said. “I abide by the jury decision. I will do that and I will not pardon him.” White House press secretary Karine Jean-Pierre said as recently as Nov. 8 that Biden would not pardon his son. In his statement Sunday, Biden said that his son had been “selectively, and unfairly, prosecuted.” Biden has been concerned — as Hunter Biden was — about his political adversaries. Also, the president is no longer running for office. He made his no-pardon pledge before he dropped out of the presidential race in June. In his statement, the president said it was clear that his son was treated differently from other defendants in similar predicaments. The plea deal unraveled and Biden’s political opponents took credit for pressuring the process, he said. “No reasonable person who looks at the facts of Hunter’s cases can reach any other conclusion than Hunter was singled out only because he is my son — and that is wrong. There has been an effort to break Hunter — who has been five and a half years sober, even in the face of unrelenting attacks and selective prosecution. In trying to break Hunter, they’ve tried to break me — and there’s no reason to believe it will stop here. Enough is enough.” Yes. In his final weeks in office, Trump pardoned Charles Kushner, the father of his son-in law, Jared Kushner. He also pardoned multiple allies convicted in special counsel Robert Mueller’s Russia investigation. Trump over the weekend announced plans to nominate the elder Kushner to be the U.S. envoy to France in his next administration. President Bill Clinton pardoned his half-brother Roger Clinton in 2001, after he had completed a prison term for drug charges. Clinton also pardoned his former business partner Susan McDougal, who had been sentenced to two years in prison for her role in the Whitewater real estate deal. Change Healthcare, a company that processes medical insurance claims nationwide, experienced a data breach in February that might have affected millions of patients, including some in Walla Walla. Change Healthcare is a company based in Nashville, Tennessee. Its services for health care providers include insurance claims processing and prior authorizations for certain insurance companies. According to the company, the data breach affected about 100 million people in the United States. The organization was able to confirm that number in October and said that 100 million notices had been sent out to individuals. Local impact Change Healthcare’s services are used by several providers, such as Walla Walla Clinic and Providence St. Mary Medical Center, as well as most pharmacies. Company spokesperson Tyler Mason said the investigation into the breach, conducted by the U.S. Department of Health and Human Services’ Office for Civil Rights, is still in its final stages. “Change (Healthcare) continues to update the status of the event, and we also issued the substitute notification via the wire,” Mason said in an email. “Most importantly, Change Healthcare is also in regular communication with the U.S. Department of Health and Human Services' Office for Civil Rights and other regulators regarding our notification process. We are committed to notifying potentially impacted individuals as quickly as possible.” Mason did not respond to a request for comment about the number of people in the Walla Walla area who were affected. Walla Walla Clinic CEO Kevin Michelson confirmed that Walla Walla Clinic did have patients whose claims were delayed because of the data breach, although he was not told how many. “They did not give us a list of patients who were impacted,” Michelson said. “We were aware of it pretty much from the beginning and then as part of the formal notification process, we received a letter from them indicating that they would be notifying our patients that may have been impacted.” Michelson said when the breach happened, most insurance companies were quick to work with the clinic on processing claims in other ways, although there were a few who took months to work out the issue. “In the short run, money that we were receiving for services provided to patients was significantly delayed, which then meant until the insurance companies processed those claims, patients may have been impacted because they might not have seen a bill processed by their insurance company for several weeks or months,” Michelson said. Providence St. Mary Medical Center spokesperson Emily Volland said the data breach had little effect on the hospital other than a few patients who had trouble filling their prescriptions at outpatient pharmacies. Walgreens pharmacy said it was also largely unaffected by the breach. “Our pharmacy operations and the vast majority of prescriptions across the country were not impacted by this third-party issue,” Walgreens spokesperson Jen Cotto said. “For the small percentage that were affected, we had procedures in place so that we continued to process and fill prescriptions with minimal delay or interruption.” Tallman’s , a Good Neighbor Pharmacy located in downtown Walla Walla, declined to comment, although a pharmacist confirmed they have used Change Healthcare’s services in the past. Change Healthcare announced in October that its clearinghouse services had been fully restored and it began the repayment process of the Temporary Funding Assistance Program. This program helped providers who faced cash flow issues during the data breach. As of Tuesday, Oct. 15, recipients had repaid $3.2 billion. Protecting information Change Healthcare’s website says the types of data that could have been affected include insurance information, health information, billing, claims and payment information and other personal information such as Social Security numbers and driver's license or state ID numbers. For anyone who thinks their data might have been compromised during the cyberattack, Change Healthcare is allowing individuals to enroll for two years of complimentary credit monitoring and identity protection services through IDX, A ZeroFox Company , based in Beaverton, Oregon. Change Healthcare recommends that patients regularly monitor their explanation of benefits statements for unfamiliar activity and contact their health plan or doctor if they notice anything out of the ordinary. Their website also recommends that individuals monitor their bank and credit card statements for suspicious activity and contact area law enforcement if they think they are a victim of a crime. Notices about the data breach are still being mailed out. “The data review is in its late stages,” the website states. “Change Healthcare has begun mailing written notices via U.S. mail to affected people identified in the ongoing data review for whom Change Healthcare has a sufficient address. Please note, Change Healthcare may not have sufficient addresses for all affected individuals. Stock up on these popular board games for your next get-togetherAmanda Hernández | (TNS) Stateline.org CHICAGO — Shoplifting rates in the three largest U.S. cities — New York, Los Angeles and Chicago — remain higher than they were before the pandemic, according to a report last month from the nonpartisan research group Council on Criminal Justice. The sharp rise in retail theft in recent years has made shoplifting a hot-button issue, especially for politicians looking to address public safety concerns in their communities. Since 2020, when viral videos of smash-and-grab robberies flooded social media during the COVID-19 pandemic, many Americans have expressed fears that crime is out of control. Polls show that perceptions have improved recently, but a majority of Americans still say crime is worse than in previous years. “There is this sense of brazenness that people have — they can just walk in and steal stuff. ... That hurts the consumer, and it hurts the company,” said Alex Piquero, a criminology professor at the University of Miami and former director of the federal Bureau of Justice Statistics, in an interview. “That’s just the world we live in,” he said. “We need to get people to realize that you have to obey the law.” At least eight states — Arizona, California, Florida, Iowa, Kansas, Louisiana, New York and Vermont — passed a total of 14 bills in 2024 aimed at tackling retail theft, according to the National Conference of State Legislatures. The measures range from redefining retail crimes and adjusting penalties to allowing cross-county aggregation of theft charges and protecting retail workers. Major retailers have responded to rising theft since 2020 by locking up merchandise, upgrading security cameras, hiring private security firms and even closing stores. Still, the report indicates that shoplifting remains a stubborn problem. In Chicago, the rate of reported shoplifting incidents remained below pre-pandemic levels throughout 2023 — but surged by 46% from January to October 2024 compared with the same period a year ago. Shoplifting in Los Angeles was 87% higher in 2023 than in 2019. Police reports of shoplifting from January to October 2024 were lower than in 2023. Los Angeles adopted a new crime reporting system in March 2024, which has likely led to an undercount, according to the report. In New York, shoplifting rose 48% from 2021 to 2022, then dipped slightly last year. Still, the shoplifting rate was 55% higher in 2023 than in 2019. This year, the shoplifting rate increased by 3% from January to September compared with the same period last year. While shoplifting rates tend to rise in November and December, which coincides with in-person holiday shopping, data from the Council on Criminal Justice’s sample of 23 U.S. cities shows higher rates in the first half of 2024 compared with 2023. Researchers found it surprising that rates went up despite retailers doing more to fight shoplifting. Experts say the spike might reflect improved reporting efforts rather than a spike in theft. “As retailers have been paying more attention to shoplifting, we would not expect the numbers to increase,” said Ernesto Lopez, the report’s author and a senior research specialist with the council. “It makes it a challenge to understand the trends of shoplifting.” In downtown Chicago on a recent early afternoon, potential shoppers shuffled through the streets and nearby malls, browsing for gifts ahead of the holidays. Edward Johnson, a guard at The Shops at North Bridge, said that malls have become quieter in the dozen or so years he has worked in mall security, with the rise of online retailers. As for shoplifters, Johnson said there isn’t a single type of person to look out for — they can come from any background. “I think good-hearted people see something they can’t afford and figure nothing is lost if they take something from the store,” Johnson said as he patrolled the mall, keeping an eye out for lost or suspicious items. Between 2018 and 2023, most shoplifting in Chicago was reported in the downtown area, as well as in the Old Town, River North and Lincoln Park neighborhoods, according to a separate analysis by the Council on Criminal Justice. Newly sworn-in Cook County State’s Attorney Eileen O’Neill Burke this month lowered the threshold for charging retail theft as a felony in the county, which includes Chicago, from $1,000 to $300, aligning it with state law. “It sends a signal that she’s taking it seriously,” Rob Karr, the president and CEO of the Illinois Retail Merchants Association, told Stateline. Nationally, retailers are worried about organized theft. The National Retail Federation’s latest report attributed 36% of the $112.1 billion in lost merchandise in 2022 to “external theft,” which includes organized retail crime. Organized retail crime typically involves coordinated efforts by groups to steal items with the intent to resell them for a profit. Commonly targeted goods include high-demand items such as baby formula, laundry detergent and electronics. The same report found that retailers’ fear of violence associated with theft also is on the rise, with more retailers taking a “hands-off approach.” More than 41% of respondents to the organization’s 2023 survey, up from 38% in 2022, reported that no employee is authorized to try and stop a shoplifter. (The federation’s reporting has come under criticism. It retracted a claim last year that attributed nearly half of lost merchandise in 2021 to organized retail crime; such theft accounted for only about 5%. The group announced this fall it will no longer publish its reports on lost merchandise.) Policy experts say shoplifting and organized retail theft can significantly harm critical industries, drive up costs for consumers and reduce sales tax revenue for states. Those worries have driven recent state-level action to boost penalties for shoplifting. California Democratic Gov. Gavin Newsom signed a package of 10 bills into law in August aimed at addressing retail theft. These measures make repeated theft convictions a felony, allow aggregation of crimes across multiple counties to be charged as a single felony, and permit police to arrest suspects for retail theft even if the crime wasn’t witnessed directly by an officer. In September, Newsom signed an additional bill that imposes steeper felony penalties for large-scale theft offenses. California voters also overwhelmingly approved a ballot measure in November that increases penalties for specific drug-related and theft crimes. Under the new law, people who are convicted of theft at least twice may face felony charges on their third offense, regardless of the stolen item’s value. “With these changes in the law, really it comes down to making sure that law enforcement is showing up to our stores in a timely manner, and that the prosecutors and the [district attorneys] are prosecuting,” Rachel Michelin, the president and CEO of the California Retailers Association, told Stateline. “That’s the only way we’re going to deter retail theft in our communities.” In New Jersey, a bipartisan bill making its way through the legislature would increase penalties for leading a shoplifting ring and allow extended sentences for repeat offenders. “This bill is going after a formally organized band of criminals that deliver such destruction to a critical business in our community. We have to act. We have to create a deterrence,” Democratic Assemblymember Joseph Danielsen, one of the bill’s prime sponsors, said in an interview with Stateline. The legislation would allow extended sentences for people convicted of shoplifting three times within 10 years or within 10 years of their release from prison, and would increase penalties to 10 to 20 years in prison for leading a retail crime ring. The bill also would allow law enforcement to aggregate the value of stolen goods over the course of a year to charge serial shoplifters with more serious offenses. Additionally, the bill would increase penalties for assaults committed against retail workers, and would require retailers to train employees on detecting gift card scams. Maryland legislators considered a similar bill during this year’s legislative session that would have defined organized retail theft and made it a felony. The bill didn’t make it out of committee, but Cailey Locklair, president of the Maryland Retailers Alliance, said the group plans to propose a bill during next year’s legislative session that would target gift card fraud. Better, more thorough reporting from retailers is essential to truly understanding shoplifting trends and its full impact, in part because some retail-related crimes, such as gift card fraud, are frequently underreported, according to Lopez, of the Council on Criminal Justice. Measuring crime across jurisdictions is notoriously difficult , and the council does not track organized retail theft specifically because law enforcement typically doesn’t identify it as such at the time of arrest — if an arrest even occurs — requiring further investigation, Lopez said. The council’s latest report found conflicting trends in the FBI’s national crime reporting systems. The FBI’s older system, the Summary Reporting System, known as SRS, suggests that reported shoplifting hadn’t gone up through 2023, remaining on par with 2019 levels. In contrast, the FBI’s National Incident-Based Reporting System, or NIBRS, shows a 93% increase in shoplifting over the same period. The discrepancy may stem from the type of law enforcement agencies that have adopted the latter system, Lopez said. Some of those communities may have higher levels of shoplifting or other types of property crime, which could be what is driving the spike, Lopez said. Despite the discrepancies and varying levels of shoplifting across the country, Lopez said, it’s important for retailers to report these incidents, as doing so could help allocate law enforcement resources more effectively. “All law enforcement agencies have limited resources, and having the most accurate information allows for not just better policy, but also better implementation — better use of strategic resources,” Lopez said. Recommended Videos New numbers from Angus Reid find the number of people who feel “very proud” to be a Canadian has taken a precipitous dive over the past four decades, with just 34% saying they take great pride in their citizenship. That’s compared to 1985, when 78% of respondents reported feeling “very proud” to be a Canadian. “The years since the onset of COVID-19 have been a well-documented period of division and discord in this country, with Canadians expressing concerns about the lack of a ‘middle’ option politically, an unwillingness from governments to work together for the people, weakening compassion and growing space between Canadians,” read the report published online by the Angus Reid institute . According to Environics polls conducted at the time, that number fell from 78% to 71% in 1994. A Carleton University/International Social Survey Programme (ISSP) poll conducted in 2003 found that number had fallen to 68% , falling again in 2016 to 52%, and 34% in 2024. Forty-nine per cent of the 2024 respondents agreed with a statement saying they had a deep emotional attachment to Canada, and that they love the country and what it stands for — a number that fell from 62% in 2016 and 65% in 1991. As well, 37% in 2024 said they have an attachment to Canada, but only as long as it provides a good standard of living — up from 31% in 2016 and 19% in 1991. Eight per cent said they feel no attachment to Canada and would like to see if split up into smaller countries, up from 5% in 2016 but down from 9% in 1991, while those who would like Canada absorbed into the United States sits at 6% — 2% in 2016 and 5% in 1991. These feelings seem consistent across the country. “Quebec is least likely to have downward movement on attachment (-7,) but this is largely due to its starting point, already lowest in the country (37%,)” the report read. “The number of Albertans saying they have a deep emotional attachment has dropped 20 points from 67 to 47% since 2016.” RECOMMENDED VIDEO Politically, respondents who profess support for the federal Conservatives were more likely to say that Canada should join the United States, while those expressing deep, emotional attachment to Canada were more likely to support the federal Liberals. Newer immigrants who’ve been in Canada for under a decade are more likely to say they feel attached to Canada as long as they maintain a good standard of living, a feeling that diminishes the longer they stay here — just over half of new immigrants feel that way, which drops to 45% among those who’ve been here 10 to 20 years, and falls to just 33% for those who’ve been in Canada for over 20 years.
