mnl168.ph login Fadnavis Poised for Maharashtra's CM: Key BJP Meeting AheadBy ALANNA DURKIN RICHER WASHINGTON (AP) — One year after the Jan. 6, 2021 , U.S. Capitol attack, Attorney General Merrick Garland said the Justice Department was committed to holding accountable all perpetrators “at any level” for “the assault on our democracy.” That bold declaration won’t apply to at least one person: Donald Trump. Special counsel Jack Smith’s move on Monday to abandon the federal election interference case against Trump means jurors will likely never decide whether the president-elect is criminally responsible for his attempts to cling to power after losing the 2020 campaign. The decision to walk away from the election charges and the separate classified documents case against Trump marks an abrupt end of the Justice Department’s unprecedented legal effort that once threatened his liberty but appears only to have galvanized his supporters. The abandonment of the cases accusing Trump of endangering American democracy and national security does away with the most serious legal threats he was facing as he returns to the White House. It was the culmination of a monthslong defense effort to delay the proceedings at every step and use the criminal allegations to Trump’s political advantage, putting the final word in the hands of voters instead of jurors. “We always knew that the rich and powerful had an advantage, but I don’t think we would have ever believed that somebody could walk away from everything,” said Stephen Saltzburg, a George Washington University law professor and former Justice Department official. “If there ever was a Teflon defendant, that’s Donald Trump.” While prosecutors left the door open to the possibility that federal charges could be re-filed against Trump after he leaves office, that seems unlikely. Meanwhile, Trump’s presidential victory has thrown into question the future of the two state criminal cases against him in New York and Georgia. Trump was supposed to be sentenced on Tuesday after his conviction on 34 felony counts in his New York hush money case , but it’s possible the sentencing could be delayed until after Trump leaves office, and the defense is pushing to dismiss the case altogether. Smith’s team stressed that their decision to abandon the federal cases was not a reflection of the merit of the charges, but an acknowledgement that they could not move forward under longstanding Justice Department policy that says sitting presidents cannot face criminal prosecution. Trump’s presidential victory set “at odds two fundamental and compelling national interests: On the one hand, the Constitution’s requirement that the President must not be unduly encumbered in fulfilling his weighty responsibilities . . . and on the other hand, the Nation’s commitment to the rule of law,” prosecutors wrote in court papers. The move just weeks after Trump’s victory over Vice President Kamala Harris underscores the immense personal stake Trump had in the campaign in which he turned his legal woes into a political rallying cry. Trump accused prosecutors of bringing the charges in a bid to keep him out of the White House, and he promised revenge on his perceived enemies if he won a second term. “If Donald J. Trump had lost an election, he may very well have spent the rest of his life in prison,” Vice President-elect JD Vance, wrote in a social media post on Monday. “These prosecutions were always political. Now it’s time to ensure what happened to President Trump never happens in this country again.” After the Jan. 6 attack by Trump supporters that left more than 100 police officers injured, Republican leader Mitch McConnell and several other Republicans who voted to acquit Trump during his Senate impeachment trial said it was up to the justice system to hold Trump accountable. The Jan. 6 case brought last year in Washington alleged an increasingly desperate criminal conspiracy to subvert the will of voters after Trump’s 2020 loss, accusing Trump of using the angry mob of supporters that attacked the Capitol as “a tool” in his campaign to pressure then-Vice President Mike Pence and obstruct the certification of Democrat Joe Biden’s victory. Hundreds of Jan. 6 rioters — many of whom have said they felt called to Washington by Trump — have pleaded guilty or been convicted by juries of federal charges at the same courthouse where Trump was supposed to stand trial last year. As the trial date neared, officials at the courthouse that sits within view of the Capitol were busy making plans for the crush of reporters expected to cover the historic case. But Trump’s argument that he enjoyed absolute immunity from prosecution quickly tied up the case in appeals all the way up to the Supreme Court. The high court ruled in July that former presidents have broad immunity from prosecution , and sent the case back to the trial court to decide which allegations could move forward. But the case was dismissed before the trial court could get a chance to do so. But U.S. District Judge Aileen Cannon dismissed the case in July on grounds that Smith was illegally appointed . Smith appealed to the Atlanta-based 11th U.S. Circuit Court of Appeals, but abandoned that appeal on Monday. THE SOURCES WHAT WE FOUND On Dec. 2, a company calling itself Enron Corporation published a promotional video on social media, introduced a new website and issued a press release announcing a relaunch of the company. But the relaunched website calls itself a parody. The new company with the infamous name is owned by Connor Gaydos, the co-founder of satirical conspiracy group “Birds Aren’t Real.” A disclaimer on the website’s terms of service page reads, “THE INFORMATION ON THE WEBSITE IS FIRST AMENDMENT PROTECTED PARODY, REPRESENTS PERFORMANCE ART, AND IS FOR ENTERTAINMENT PURPOSES ONLY.” VERIFY reached out to the media contact listed on Enron’s website and in the press release about the site’s relaunch. Tensions peaked in January 2023 after the 14th vote failed, leading to a confrontation where representative Mike Rogers of Alabama, chair of the House Armed Services Committee, had to be physically restrained after lunging at Gaetz. Gaetz's continued opposition to McCarthy had been a major obstacle to McCarthy securing the speaker's position. McCarthy eventually won on the next ballot, and Rogers later apologised for his actions. McCarthy ultimately secured the speaker's position, but Gaetz and a group of conservative lawmakers continued to hold significant leverage over him. Under House rules, a single member could initiate the process to remove the speaker. In October 2023, Gaetz triggered this process by filing a motion to vacate, and with the support of seven other Republicans and House Democrats, McCarthy was ousted. The list of President-elect Donald Trump's legal cases is shrinking — or being delayed. On Monday, Special Counsel Jack Smith filed a motion to dismiss the Washington, D.C. election subversion case. He also asked a federal appeals court to stop reviewing the classified documents case in Florida. On Tuesday, that court granted dismissal of the case against Trump — though not against other appellees. In dismissing the cases, the Special Counsel cited the Department of Justice's long-standing policy of not prosecuting sitting presidents. "After careful consideration, the Department has determined that OLC's prior opinions concerning the Constitution's prohibition on federal indictment and prosecution of a sitting President apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated," Smith wrote in his court filing regarding the election subversion case. "We've used the word unprecedented a lot over the course of the last four years, and yet again this is something that is unprecedented, and Smith himself said this in his motion," former state and federal prosecutor David S. Weinstein told Scripps News. "He took great detail to point out that this was not based on the strength or weakness of the case." In a post on Truth Social , Trump said in part "These cases, like all of the other cases I have been forced to go through, are empty and lawless." He was convicted in his New York hush money case in May, but sentencing — which was scheduled for this week — has been delayed . After Smith's actions Monday, Trump now faces only the Georgia election interference case. In Georgia, Trump was indicted along with 18 allies, accused of trying to overturn the 2020 election results in the state. But that case is now on hold after the state appeals court unexpectedly removed a December hearing from its calendar. That court will issue a new order on how this case will move forward, but with less than two months before the inauguration, the future of the Georgia and New York hush money cases are still being decided. "The two state cases are likely to recede into the background — at best," former Department of Justice attorney and current partner at Gelber, Schachter & Greenberg, Barbara Llanes, told Scripps News. "We probably won't hear much about these cases following the inauguration of President-elect Trump." Defense attorneys for Trump believe his election victory is enough for the hush money case to be dismissed. They need to file a motion by Dec. 2 making that argument. Then prosecutors have until Dec. 9 to file a rebuttal. They still believe Trump should be sentenced — even if it's after he leaves office. Judge Juan Merchan will then make a decision on how this case should move forward. There's no set date on exactly when he will make that decision.

Founded over 50 years ago, the California Air Resources Board (CARB) has been a world leader in air pollution control, smog reduction, and climate science. And the air across Southern California is better for it. However, CARB’s new “In-Use Locomotive Regulation,” mandating railroads like Union Pacific and BNSF set aside hundreds of millions of dollars today for the technology of the future, risks undermining this precarious balance. While the goal of reducing emissions is commendable, the technology required to meet this mandate is not yet commercially viable to move freight across the country. BNSF has said that its planned $1.5 billion investment in the Barstow International Gateway (BIG) is in jeopardy if the regulation moves forward. As a result, this regulation could jeopardize over 20,000 direct and indirect jobs in the high desert. BNSF plans to develop the 4,500-acre Barstow rail yard, intermodal facility and warehouses for transloading freight project in the next few years, creating thousands of jobs and reducing truck miles traveled from the 130-mile trip from the ports to the Inland Empire along the Interstate 15 corridor. The project would also reduce vehicle miles traveled up and down the Cajon Pass from high desert residents who would have job opportunities closer to home. However, the costs of complying with the regulation and transitioning to non-existent technology would divert capital and resources from railroads, threatening the viability of significant investments like BIG. The potential loss of the BIG project would deal a significant blow to the local economy, particularly to the working families in the region. Moreover, over 86,000 businesses and one in nine jobs in Southern California connected to the San Pedro Bay Port Complex depend on efficient rail connections. Maintaining these connections is essential for the region’s growth and stability and we cannot afford increased traffic congestion and carbon emissions from continuing to force freight onto highways. Our organizations agree with CARB on this: we see a path forward for zero emissions locomotives; we need to convene to align timing, technology, and transition. As Californians, we understand the urgency of transitioning to a zero-emission future, but we must also ensure that our policies support both environmental and economic sustainability. By aligning climate goals with technological capabilities, we can protect jobs, support economic growth, and continue to lead in the fight against climate change while maintaining good jobs for working families in our region.
