The case, centered on the California Coastal Commission’s decision to deny a sea wall for 10 vulnerable townhouses near Half Moon Bay, is playing out at the First District Court of Appeal in San Francisco. It has been closely watched by environmental groups, builders and oceanfront cities across the state as sea levels continue to rise due to climate change, putting billions of dollars of property at risk. “It’s a big deal,” said Charles Lester, director of the Ocean and Coastal Policy Center at UC Santa Barbara. “This will potentially resolve a question that’s been under debate for years now.” In late October, the appeals court issued a tentative opinion agreeing with the Coastal Commission that buildings constructed after Jan. 1, 1977, are not entitled to obtain permits to build sea walls. The state’s landmark Coastal Act took effect on that date. It says the commission “shall” issue permits for sea walls and other types of armoring to protect “existing structures” against erosion from battering waves. But state lawmakers never clearly defined the term. Property owners have argued “existing structures” means any building present at the time the permit application is filed. But the Coastal Commission’s attorneys have argued in recent years that “existing structures” only means those built before 1977. They cite a growing body of scientific evidence that shows that construction of concrete walls along the coast stops bluffs from eroding, depriving public beaches of sand. Such armoring also stops beaches from naturally migrating inland, resulting in them becoming submerged over time. “Sea level rise is a new game in town,” said Lester, the former executive director of the Coastal Commission from 2011 to 2016. “The shoreline is moving landward. We’re looking at projections of losing a significant amount of California’s beaches due to sea level rise. And most of that is in places that have a lot of sea walls.” The court scheduled a Dec. 11 hearing and then will issue a final opinion. In its tentative opinion, the judges cited earlier versions of the Coastal Act as it was being debated in the state Legislature, and showed how broad language allowing sea walls was tightened to read “existing structures.” “If the Legislature intended to guarantee any structure shoreline protection — regardless of when it was constructed — it could have retained the broad language,” the appeals court wrote. Private property rights groups are unhappy. “There may not be a simple solution. But reinterpreting the Coastal Act to sacrifice the rights of coastal landowners isn’t the way to solve these problems,” said Jeremy Talcott, an attorney with the Pacific Legal Foundation , a Sacramento property rights group. “Simply allowing thousands of homes to fall into the sea is a very drastic decision.” The case will decide the fate of a quiet neighborhood on the San Mateo County coast. In 2016, a severe storm caused 20 feet of bluffs to collapse into the ocean in front of Casa Mira, a complex of 10 townhouses on Mirada Road that’s 2 miles north of Half Moon Bay. Worried their homes were in imminent danger, the owners obtained an emergency permit from the Coastal Commission to place boulders, called riprap, along the crumbling shoreline to block the waves from causing more damage. But when they applied to build a permanent 257-foot concrete sea wall, the commission said no. “Sea walls eat away at the beach,” said the commission’s chairwoman, Dayna Bochco, during the 2019 meeting. “So someday as this keeps moving in and in, you are going to lose that beach if you have that sea wall. I think it’s anti-access.” The commissioners voted to allow only 50 feet of sea wall to be constructed in front of an adjacent four-unit apartment building that was built in 1972. They said the Casa Mira, whose townhouses were built in 1984, couldn’t have a sea wall. The Casa Mira Homeowners Association owners sued and won in San Mateo County Superior Court last year. The Coastal Commission appealed. In its tentative opinion, the appeals court overturned much of the lower court ruling, siding with the Coastal Commission and its Jan. 1, 1977, cutoff date. The appeals court said the Casa Mira homeowners still can get the sea wall they want, however. But only because it would protect a portion of the California Coastal Trail that runs between their homes and the public beach below, making it a “coastal dependent” use to improve public access that is allowed protection under the Coastal Act. Joshua Emerson Smith, a Coastal Commission spokesman, said the agency will withhold comment until the appeals court issues its final ruling. Thomas Roth, a San Mateo attorney who represents the Casa Mira Homeowners Association, did not respond to requests for comment. With so much at stake, experts say the issue could end up at the state Supreme Court next year. For that to happen, one of the parties would have to appeal, and the court would have to agree to take the case. Numerous groups filed briefs in the case, including the Surfrider Foundation , the Bay Area Council and the California Building Industry Association . “This is not just a California problem,” Lester said. “There are houses falling into the ocean in North Carolina, in Hawaii and other places. We’re not going to stop the ocean from rising. The question is what do we choose to protect over the long run? What’s in the public interest? Performances will include Lil Wayne and GloRilla on Saturday; and Camila Cabello, Myles Smith and Knox on Sunday. On game day, the Allstate Championship Tailgate, taking place just outside Mercedes-Benz Stadium in the Home Depot Backyard, will feature country acts on the Capital One Music Stage, including global superstar Kane Brown and iHeartCountry “On The Verge” artist Ashley Cooke. The concerts are just two of the festivities visiting fans can enjoy in the days leading up to the big game. The fan experience for both ticket holders and the general public has been a focus for event planners. All weekend long, an estimated 100,000 people from across the country are expected to attend fan events preceding kickoff. ( Samsung ) The Pixel Tablet That Was Reports of the cancellation of the long-awaited Pixel Tablet 2 have been building over the week and the community has accepted that, while there may be a Pixel Tablet 2 released in late 2025 or beyond, it’s not the Pixel Tablet that’s sitting inside Google right now. So the leaked specs are less “what comes next” but “what could have been.” A bigger question than the cancellation is what the ipact will be on Android’s tablet ecosystem: "impact of the Pixel Tablet 2 cancellation is in the ecosystem. Android’s support of large-screened devices falls behind Apple’s efforts to keep iPad hardware tightly connected. Qualcomm's New Mid-Range Benchmark Just as Qualcomm’s Snapdragon 8 Elite chipset is driving the next generation of Android smartphones, the soon-to-be-launched and presumptively named Snapdragon 8s Elite could offer a similar step up in performance to the mid-range handsets currently running the 8s Gen 2 and 8s Gen 3 chipsets: "we thought the Snapdragon 8s Gen 3 was a great upper mid-range processor. Our own testing revealed that the POCO F6 (Snapdragon 8s Gen 3) was able to beat the POCO F6 Pro (Snapdragon 8 Gen 2) for single-core CPU performance while staying competitive during GPU stress tests. During the launch of the Pixel 9 family, Google confirmed that the four handsets woudl recieve seven years of software and security updates. That’s a far cry form the three years offered to the Pixel 6. Those years expired in October with the release of Android 15, but an update to its support pages shows that Google has handed the Pixel 6 an additional two years: “[Pixel 7a, Pixel 7, Pixel 7 Pro, Pixel 6a, Pixel 6, Pixel 6 Pro & Pixel Fold] will get updates for 5 years starting from when the device first became available on the Google Store in the US. One that dates to 2020, when the program first started to crack, although it would not become visible for months. A program so exhausted from pandemic restrictions and hassles that it removed itself from bowl consideration — while illegally hosting recruits during the same stretch. A program that failed to develop quarterback Jayden Daniels , who transferred and became the best player in the sport. Advertisement A program that slapped a bowl ban on itself to atone for its recruiting sins, getting ahead of the NCAA probation that followed. In 2022 and 2023, the Sun Devils posted back-to-back three-win seasons, their worst two-year stretch since the 1940s. This is old news, something Arizona State fans don’t care to rehash, but it’s necessary context to understand the steep mountain in which the Sun Devils have hiked to get to the stage on which they stood Saturday. The reversal came sooner than expected, a surprise within the sport and even the program. Dillingham admitted weeks ago the Sun Devils were ahead of schedule. Running backs coach Shaun Aguano said he and fellow coaches pinched themselves after each important win. As the calendar flipped to November, a time when feel-good stories begin to wilt, the Sun Devils accelerated to an unthinkable level, running off six in a row. (Writer admission: “Unthinkable” is a terrible word. Everything is thinkable. But this is the rare case in which the adjective actually fits. The sportswriting community is an “I-told-you-so” lot, first-string armchair quarterbacks, yet no one thought this was possible. Maybe next year. Or the year after that. Or for the miserable pessimists, never.) “Everybody in this building loves each other, and you can see that in our play,” safety Xavion Alford said. “They predicted us to be last in this conference. But I guarantee you nobody in the building thought we were the worst team in this conference. GO DEEPER Cameron Skattebo, as Arizona State shifts to the Big 12, meets a new audience Credit Dillingham, the most entertaining coach in the sport, for activating a Valley that many assumed had lost voltage. Dillingham not only has preached his message at every opportunity, he also has connected with his team in uncommon ways. Receivers coach Hines Ward says his boss stinks at “Madden,” yet “he goes out there and talks trash with all the players and they love it.” Ward’s point: The Sun Devils want to play for him. In a sport of swelling entitlement, this should not go unnoticed. Advertisement Credit Skattebo, the wrecking-ball running back who ripped off runs of 28, 47 and 53 yards, boosting his case to be a Heisman Trophy finalist. In August, The Athletic showed Skattebo a newspaper photo of him running the ball in a high school state championship game. He was running outside, yet looking inside. Skattebo was asked: What are you looking at? Skattebo answered: “Somebody to hit.” On Oct. 11, Arizona State beat No. 16 Utah in Tempe. Students rushed the field that night. It felt like the high point of a rebuilding season, but it was only the first chapter. This story keeps getting better. A come-from-behind win against UCF . A fast start at Kansas State . A jaw-dropping finish against BYU . A beat down of rival Arizona. From one week to the next, a good team became great. Superstar Jaylen Brown may return as well, but it will be a gametime decision after his shooting warm ups. The Celtics were going into tonight thinking their entire superstar cast was going to be possibly out , so this is a welcome surprise. Tatum and White are the team’s first and third leading scorers, so it makes it easier for the rest of the team to fill in the gaps. If Brown returns, he’s the second leading scorer, which makes it all the better. However, losing Hauser hurts. He is one of the best 3&D players in the league, and his stats prove it. He provides eight points per game off the bench off of 35% from deep. Hopefully his personal reasons don’t make him take too much time off, but he should take as much time as he needs to get sorted.
