ATLANTA (AP) — A judge is weighing whether a Georgia state Senate committee has the right to subpoena testimony and documents from Fulton County District Attorney Fani Willis as it looks into whether she has engaged in misconduct during her prosecution of President-elect Donald Trump. The Republican-led committee sent subpoenas to Willis in August seeking to compel her to testify at its September meeting and to produce scores of documents. The committee was formed earlier this year to examine allegations of “various forms of misconduct” by Willis, an elected Democrat, during her prosecution of over their efforts to overturn the former president’s 2020 election loss in Georgia. Willis’ attorney, former Democratic Gov. Roy Barnes, told Fulton County Superior Court Judge Shukura Ingram during a hearing Tuesday that although the Georgia General Assembly has subpoena power, that power is not automatically conferred on a single legislative chamber or its committees. Even if the committee did have such power, he argued, the subpoenas in question are overly broad and not related to a legitimate legislative need. Barnes said the focus on Willis and her investigation into Trump shows that the committee was politically motivated and not a legitimate inquiry into the practices of district attorneys’ offices: “What they were trying to do is chill the prosecution of Donald Trump and find out what they had.” Josh Belinfante, a lawyer representing the lawmakers, said there is nothing in the Georgia Constitution that prohibits the Senate from issuing a subpoena. The duly formed interim committee is looking into whether new legislation is needed to regulate the practices of district attorneys’ offices in the state, he argued. “They are investigating and making an inquiry into these allegations that may show that existing state laws, including those establishing the processes for selecting, hiring and compensating special assistant district attorneys, are inadequate,” Belinfante said. The resolution creating the committee focused in particular on Willis’ hiring of , with whom she had a , to lead the prosecution against Trump and others. It says the relationship amounted to a “clear conflict of interest and a fraud upon the taxpayers” of the county and state. One of the committee’s subpoenas orders Wills to produce documents related to Wade, including documents related to his hiring and payment, documents related to money or items of value that Wade and Willis may have exchanged, text messages and emails between the two, and their phone records. The committee also requested any documents her office sent in response to requests from the U.S. House, as well as communications Willis and her office had with the White House, the U.S. Justice Department and the House relating to the 2020 presidential election. And they asked for documents related to federal grant money Willis’ office has received. Before the deadlines in the subpoenas, Willis challenged them in court. Willis’ challenge was pending in mid-September when she during which the committee members had hoped to question her. In October, the committee asked Ingram to require Willis to comply with the subpoenas. The committee’s lawyers wrote in a court filing that Willis’ failure to do so had delayed its ability to finish its inquiry and to provide recommendations for any legislation or changes in appropriations that might result. Barnes also argued that once the regular legislative session has adjourned, which happened in March this year, legislative committees can meet to study issues and come up with recommendations but do not have the power to compel someone to appear or produce documents. Belinfante rejected that, saying the state Constitution expressly permits the creation of interim committees and allows them to make their rules. Even if these subpoenas were validly issued, Barnes argued, they ask for too much, including private and personal information that is not a legitimate target of a legislative subpoena. Belinfante said the lawmakers are simply trying to do their jobs. He asked that Willis be ordered to appear before the committee in early January. He also asked that she be ordered to provide the requested documents and explain what privilege justifies any that are excluded. With a glaring lack of state case law on the issue of the General Assembly’s subpoena power, that’s one issue Ingram will have to address. She said she will consider the arguments and release her order as soon as she can. Willis and Wade have but have said it began after he was hired and ended before the indictment against Trump was filed. Trump and other defendants argued that the that should disqualify Willis and her office from continuing with her prosecution of the case. UTICA — Another level of youth hockey is joining teams in downtown Utica starting in 2025, with the program recruiting top “boys and girls players from across North America” as part of a partnership with Notre Dame Junior-Senior High School. Rob Esche, the top Mohawk Valley Garden (MVG) umbrella group and Utica Comets official, and longtime Utica University men’s hockey coach Gary Heenan have created a hockey development program called the Notre Dame Hockey Academy, it was officially announced Monday. The organization had been teased on social media last Thursday, touting it as a “new era.” Esche, the 46-year-old Whitesboro native and former NHL goaltender, has been the president of MVG and the Utica Comets since 2013. MVG manages the operations for multiple venues and properties, including the Adirondack Bank Center and Nexus Center in downtown Utica. The 50-year-old Heenan has been the men’s hockey head coach for the Utica University team since 2000. He also played for seasons at Hamilton College in Clinton. The academy’s leadership includes Keith Veronesi, who returned to Utica last summer to be chief revenue officer with MVG, according to the release. He worked as the director of scouting for Vegas’ NHL squad and also played hockey at prep school. Notre Dame Hockey Academy is set to begin in fall 2025 and play a schedule in Tier I AAA, which is considered the top youth level in North America. There are to be under-15 and under-16 boys teams as well as an under-16 girls team. As part of the development program, players will be enrolled at Notre Dame Junior/Senior High School on Burrstone Road in Utica, according to a news release. Notre Dame is Utica’s lone co-ed Catholic high school and part of the Roman Catholic Diocese of Syracuse. Paid tuition is required to attend. The Notre Dame Hockey Academy is set to be based out of the Nexus Cen ter, the $64 -million, nearly 170,000-square-foot multi-surface sports complex that opened in November 2022. The venue, which has been host to various sporting events over the last two years, is attached to the Adirondack Bank Center. The organization is set to have “dedicated locker rooms, a players’ lounge, classrooms, and video analysis rooms exclusively for academy use,” a release said. Nexus is also home to the Utica Jr. Comets program — the organization is led by Esche and has multiple teams since 2019 — as well Utica University’s NCAA Division III women’s hockey team. The combined Section III high school teams — the Mohawk Valley Jugglers boys squad and Clinton Comets girls — also play home games at the facility. Notre Dame Athletic Director David Gardinier told the Daily Sentinel on Monday that the Jugglers program “will not be affected by (the creation of the Notre Dame Hockey Academy) and will continue as normal.” The academy’s players will be housed at Campus West Apartments, according to the program’s website. The apartments, which were renovated in recent years, are located near Notre Dame on Burrstone Road. Heenan has had a stake in the property since at least 2018. There are similar hockey programs located around the United States. One of the most notable in New York state is Bishop Kearney Selects in Rochester. The Notre Dame Hockey Academy teams are set to play 50 to 60 games in a “highly competitive” season and participate “in premier showcases designed to attract NHL scouts, NCAA Division I coaches, and high-level junior hockey organizations.” Additional staff announcements, including coaches for the Notre Dame Hockey Academy, were not announced Monday. SEATTLE (AP) — The Seattle Seahawks took a bumpy path to sole possession of first place in the NFC West. featured several special teams miscues, including a 99-yard kickoff return for a touchdown by New York. On the flip side, the Seahawks got their second pick-6 in as many weeks and just enough production by Geno Smith and the offense. The Seahawks' uneven performance was characteristic of a season in which they started 3-0, then lost five of six before winning another three in a row to take command of their underachieving division. Seattle (7-5) leads Arizona by one game, with a matchup against the Cardinals looming next weekend. Zach Charbonnet gave Seattle its first lead of the day on an 8-yard touchdown run with 5:37 to go, and the Seahawks' defense capped another strong outing with a game-sealing stop on fourth down. Dee Williams fumbled on a kickoff in the first quarter to give New York the ball at the 27-yard line, and four plays later, Rodgers hit Isaiah Davis for a touchdown to give the Jets a 14-0 lead. Laviska Shenault Jr. muffed two kicks and fumbled at the Seattle 38-yard line in the second quarter. Seattle also had an extra point blocked. Stock up Smith led his third game-winning drive of the season and his 11th since he became Seattle’s starting quarterback in 2022. Facing the team that drafted him in 2013, Smith went 20 of 31 for 206 yards and a touchdown. For the first time in five weeks, he was not intercepted. The Seahawks trailed by 14 points on two occasions, but Smith brought Seattle back while avoiding the untimely picks that dogged him recently. He threw a 12-yard touchdown pass to A.J. The Seahawks got a first down after Jets cornerback Quantez Stiggers was flagged for pass interference on Metcalf, and eight players later, Charbonnet scored to put Seattle ahead. Without going for it on fourth down from their own 38, the Seahawks likely would’ve lost. ARLINGTON, Texas – The roof at the home of the Dallas Cowboys opened without incident and will stay that way for a Monday night meeting with the Cincinnati Bengals. It was to be the first game with the roof open at AT&T Stadium since Oct. 30, 2022, a 49-29 Dallas victory over Chicago. Recommended Videos The roof was supposed to be open three weeks ago for Houston's 34-10 victory on another Monday night, but a large piece of metal and other debris fell roughly 300 feet to the field as the retractable roof was opening about three hours before kickoff. The Cowboys decided to close the roof after the incident, and it remained that way for the game. There were no injuries, and the start of the game wasn't delayed. The club said at the time it would investigate the cause with a plan to reopen the roof when it was deemed safe. Wind was cited as a cause for the falling debris. There were gusts of at least 30 mph in the afternoon before the meeting with the Texans. Suchir Balaji, a former OpenAI engineer and whistleblower who helped train the artificial intelligence systems behind ChatGPT and later said he believed those practices violated copyright law, has died, according to his parents and San Francisco officials. He was 26. Balaji worked at OpenAI for nearly four years before quitting in August. He was well-regarded by colleagues at the San Francisco company, where a co-founder this week called him one of OpenAI's strongest contributors who was essential to developing some of its products. “We are devastated to learn of this incredibly sad news and our hearts go out to Suchir’s loved ones during this difficult time,” said a statement from OpenAI. Balaji was found dead in his San Francisco apartment on Nov. 26 in what police said “appeared to be a suicide. No evidence of foul play was found during the initial investigation.” The city's chief medical examiner's office confirmed the manner of death to be suicide. His parents Poornima Ramarao and Balaji Ramamurthy said they are still seeking answers, describing their son as a “happy, smart and brave young man” who loved to hike and recently returned from a trip with friends. Balaji grew up in the San Francisco Bay Area and first arrived at the fledgling AI research lab for a 2018 summer internship while studying computer science at the University of California, Berkeley. He returned a few years later to work at OpenAI, where one of his first projects, called WebGPT, helped pave the way for ChatGPT. “Suchir’s contributions to this project were essential, and it wouldn’t have succeeded without him,” said OpenAI co-founder John Schulman in a social media post memorializing Balaji. Schulman, who recruited Balaji to his team, said what made him such an exceptional engineer and scientist was his attention to detail and ability to notice subtle bugs or logical errors. “He had a knack for finding simple solutions and writing elegant code that worked,” Schulman wrote. “He’d think through the details of things carefully and rigorously.” Balaji later shifted to organizing the huge datasets of online writings and other media used to train GPT-4, the fourth generation of OpenAI's flagship large language model and a basis for the company's famous chatbot. It was that work that eventually caused Balaji to question the technology he helped build, especially after newspapers, novelists and others began suing OpenAI and other AI companies for copyright infringement. He first raised his concerns with The New York Times, which reported them in an October profile of Balaji . He later told The Associated Press he would “try to testify” in the strongest copyright infringement cases and considered a lawsuit brought by The New York Times last year to be the “most serious.” Times lawyers named him in a Nov. 18 court filing as someone who might have “unique and relevant documents” supporting allegations of OpenAI's willful copyright infringement. His records were also sought by lawyers in a separate case brought by book authors including the comedian Sarah Silverman, according to a court filing. “It doesn’t feel right to be training on people’s data and then competing with them in the marketplace,” Balaji told the AP in late October. “I don’t think you should be able to do that. I don’t think you are able to do that legally.” He told the AP that he gradually grew more disillusioned with OpenAI, especially after the internal turmoil that led its board of directors to fire and then rehire CEO Sam Altman last year. Balaji said he was broadly concerned about how its commercial products were rolling out, including their propensity for spouting false information known as hallucinations. But of the “bag of issues” he was concerned about, he said he was focusing on copyright as the one it was “actually possible to do something about.” He acknowledged that it was an unpopular opinion within the AI research community, which is accustomed to pulling data from the internet, but said “they will have to change and it’s a matter of time.” He had not been deposed and it’s unclear to what extent his revelations will be admitted as evidence in any legal cases after his death. He also published a personal blog post with his opinions about the topic. Schulman, who resigned from OpenAI in August, said he and Balaji coincidentally left on the same day and celebrated with fellow colleagues that night with dinner and drinks at a San Francisco bar. Another of Balaji’s mentors, co-founder and chief scientist Ilya Sutskever, had left OpenAI several months earlier , which Balaji saw as another impetus to leave.
