The United States Court of Appeals for the District of Columbia Circuit has rejected TikTok’s emergency motion to temporarily halt a law that could see the app banned in the US unless its Chinese parent company, ByteDance, divests from it. This decision intensifies the uncertainty surrounding TikTok’s future in the country as the deadline approaches. TikTok’s emergency motion, filed earlier in the week, sought to delay the enforcement of a law signed by President Joe Biden. Related Stories TikTok ban: American creators direct followers to Youtube, Instagram Google, Microsoft, TikTok, others pay N2.55 trillion taxes in Nigeria in half-year 2024 – NITDA The law mandates that ByteDance must divest from TikTok by January 19, 2025, or face a nationwide ban. However, the appeals court dismissed the motion, stating there’s no history of blocking a law after ruling it constitutional. “The petitioners have not identified any case in which a court, after rejecting a constitutional challenge to an Act of Congress, has enjoined the Act from going into effect while review is sought in the Supreme Court.” The court added that TikTok’s petition had relied on claims of free speech violations, which the judges had already rejected in their original decision last week. The ‘Divest or Ban ’ law emerged as part of escalating concerns over TikTok’s ownership by ByteDance, a Chinese company. The US government has long argued that this ownership poses a potential national security risk, citing fears that user data could be accessed by the Chinese government or that the app could be used for propaganda purposes. To address these concerns, President Joe Biden signed the law earlier this year, mandating that ByteDance must either divest from TikTok or face a nationwide ban by January 19, 2025. The legislation reflects bipartisan efforts to curb perceived threats from foreign-controlled technology platforms, particularly those linked to China. The law builds on previous actions taken during the Trump administration, which sought to ban TikTok outright but faced legal and procedural roadblocks. By introducing a clear deadline and divestment requirement, the ‘Divest or Ban’ law aims to resolve these issues while emphasizing the importance of safeguarding US data and security. Following the ruling, TikTok announced its intention to escalate the case to the Supreme Court. The company emphasized the potential impact on its 170 million US users if the ban is enforced. “As we have previously stated, we plan on taking this case to the Supreme Court, which has an established historical record of protecting Americans’ right to free speech. The voices of over 170 million Americans here in the US and around the world will be silenced on January 19th, 2025 unless the TikTok ban is halted,” TikTok said in a statement. TikTok has strongly opposed the law, describing it as unconstitutional. The company also claims that divesting from ByteDance is technically “unfeasible” within the given timeframe. Beijing has echoed TikTok’s stance, expressing opposition to any forced sale of the app. If TikTok fails to divest, the app could be removed from app stores, and updates or downloads would be prohibited. This would affect millions of US users who rely on the platform for content creation, entertainment, and communication.ASML INVESTOR ALERT: ASML Holding N.V. IYM: Materials Dashboard For DecemberATLANTA (AP) — Deliberations are underway in Atlanta after a year of testimony in the gang and racketeering trial that originally included the rapper Young Thug. Jurors are considering whether to convict Shannon Stillwell and Deamonte Kendrick, who raps as Yak Gotti, on gang, murder, drug and gun charges. The original indictment charged 28 people with conspiring to violate Georgia’s Racketeer Influenced and Corrupt Organizations Act. Opening statements in the trial for six of those defendants happened a year ago . Four of them, including Young Thug, pleaded guilty last month. The rapper was freed on probation. Stillwell and Kendrick rejected plea deals after more than a week of negotiations, and their lawyers chose not to present evidence or witnesses. Both seemed to be in good spirits Tuesday morning after closings wrapped the previous night. Kendrick was chatting and laughing with Stillwell and his lawyers before the jury arrived for instructions. The jury started deliberating Tuesday afternoon and was dismissed at 5 p.m. Jurors are expected to resume deliberations Wednesday morning. If they don’t reach a verdict by 3 p.m. Wednesday, the judge will send them home for the Thanksgiving weekend and they will return Monday morning. Kendrick and Stillwell were charged in the 2015 killing of Donovan Thomas Jr., also known as “Big Nut,” in an Atlanta barbershop. Prosecutors painted Stillwell and Kendrick as members of a violent street gang called Young Slime Life, or YSL, co-founded in 2012 by Young Thug, whose real name is Jeffery Williams. During closings on Monday, they pointed to tattoos, song lyrics and social media posts they said proved members, including Stillwell, admitted to killing people in rival gangs. Prosecutors say Thomas was in a rival gang. Stillwell was also charged in the 2022 killing of Shymel Drinks, which prosecutors said was in retaliation for the killing of two YSL associates days earlier. Defense attorneys Doug Weinstein and Max Schardt said the state presented unreliable witnesses, weak evidence and cherry-picked lyrics and social media posts to push a false narrative about Stillwell, Kendrick and the members of YSL. Schardt, Stillwell's attorney, reminded the jury that alleged YSL affiliates said during the trial that they had lied to police. Law enforcement played a “sick game” by promising they would escape long prison sentences if they said what police wanted them to say, Schardt said. He theorized that one of those witnesses could have killed Thomas. The truth is that their clients were just trying to escape poverty through music, Schardt said. “As a whole, we know the struggles that these communities have had,” Schardt said. “A sad, tacit acceptance that it’s either rap, prison or death.” Young Thug’s record label is also known as YSL, an acronym of Young Stoner Life. Kendrick was featured on two popular songs from the label’s compilation album Slime Language 2, “Take It to Trial" and “Slatty," which prosecutors presented as evidence in the trial. Weinstein, Kendrick’s defense attorney, said during closings it was wrong for prosecutors to target the defendants for their music and lyrics. Prosecutor Simone Hylton disagreed, and said surveillance footage and phone evidence supported her case. “They have the audacity to think they can just brag about killing somebody and nobody’s gonna hold them accountable,” Hylton said. The trial had more than its fair share of delays. Jury selection took nearly 10 months , and Stillwell was stabbed last year at the Fulton County jail, which paused trial proceedings. Judge Paige Reese Whitaker took over after Fulton County Superior Court Chief Judge Ural Glanville was removed from the case in July because he had a meeting with prosecutors and a state witness without defense attorneys present. Whitaker often lost patience with prosecutors over moves such as not sharing evidence with defense attorneys, once accusing them of “poor lawyering.” But the trial sped up under her watch. In October, four defendants, including Young Thug , pleaded guilty, with the rapper entering a non-negotiated or “blind” plea, meaning he didn't have a deal worked out with prosecutors. Nine people charged in the indictment, including rapper Gunna , accepted plea deals before the trial began. Charges against 12 others are pending. Prosecutors dropped charges against one defendant after he was convicted of murder in an unrelated case. No turnover tax on SEZ enterprises in Gwadar: AhsanCHICAGO — In his first public remarks since last month’s election, former President Barack Obama on Thursday largely avoided direct mention of Donald Trump’s presidential victory and instead focused on the need for bridge-building and accommodation among a public whose sharp divisions have been sown in the Trump era. “You see, it’s easy to give democracy lip service when it delivers the outcomes we want. It’s when we don’t get what we want that our commitment to democracy is tested,” Obama said as he keynoted the third annual Obama Foundation Democracy Forum at a South Loop hotel. “And at this moment in history, when core democratic principles seem to be continuously under attack, when too many people around the world have become cynical and disengaged, now is precisely the time to ask ourselves tough questions about how we can build our democracies and make them work in meaningful and practical ways for ordinary people,” he said. During his speech, Obama did not mention Trump by name, his Republican successor in the 2016 election who retook the White House by defeating Vice President Kamala Harris on Nov. 5. And Obama’s talk was a far cry from the partisan attacks he leveled against Trump at the Democratic National Convention, the last time Obama was in Chicago for a public speaking engagement. At the convention in August, Obama ridiculed Trump and warned that his returning to the White House would lead to “four more years of bluster and bumbling and chaos.” But on Thursday, it was Obama the lecturer who spoke, echoing the forum’s theme of “pluralism” and calling for people to engage with others from differing viewpoints and backgrounds in order to help maintain democracy. During his speech, Obama acknowledged that in previewing to friends the forum’s planned subject matter he “got more than a few groans and eye rolls” since “as far as they were concerned, the election proved that democracy is pretty far down on people’s priorities.” “But as a citizen and part of a foundation that believes deeply in the promise of democracy — not only to recognize the dignity and the worth of every individual but to produce free and fair and more just societies — I cannot think of a better time to talk about it,” he said. “This idea that each of us has to show a level of forbearance toward those who don’t look or think or pray like us, that’s at the heart of democracy,” he said. “But it’s especially hard in big, multi-racial, multi-ethnic, multi-religious countries like the United States.” Obama noted that in America in the decades after World War II “democracy seemed to run relatively smoothly with frequent cooperation across party lines and what felt like a broad consensus about how interests were shared (and) differences should be settled.” “The biggest reason that American pluralism seemed to be working so well may have to do with what was left out,” he said, noting that even in 2004 when he was elected to the U.S. Senate he was its only Black member. “It’s fair to say that when everyone in Washington looked the same and shared the same experiences ... cutting deals and getting along was a whole lot simpler.” But starting with the rise of the Civil Rights movement in the 1960s, “historically marginalized Blacks, Latinos, Asians, Native Americans, women, gays and lesbians, disabled Americans demanded a seat at the table,” Obama said. “Not only did they insist on a fair share of government direct resources, but they brought with them new issues, more than their unique experiences, that could not just be resolved by giving them a bigger slice of the pie.” “In other words,” he said, “politics was not just a fight about tax rates or roads anymore. It was about more fundamental issues that went to the core of our being — how we expected society to structure itself.” Those issues, however, also opened the door to “politicians and party leaders and interest groups (who) take a maximalist position on almost every issue,” Obama said. “Every election becomes an act of mortal combat, which political opponents are enemies to be vanquished. Compromise is viewed as betrayal and total victory is the only acceptable outcome,” he said. “But since total victory is impossible in a country politically split down the middle, the result is a doom loop — gridlock, greater polarization, wilder rhetoric and a deepening conviction among partisans that the other side is breaking the rules and has rigged the game to tip it in their favor.” Obama, a former senior lecturer of constitutional law at the University of Chicago, has spoken frequently in his post-presidency of a need to restore civility and the need for compromise despite the nation’s political divisions. His comments Thursday took on an added dimension in the post-election climate given the history of Trump’s first term and the promises the president-elect made throughout the campaign. “I am convinced that if we want democracy, as we understand it, to survive, then we’re all going to have to work toward a renewed commitment to pluralist principles,” he said, adding that “it’s important to look for allies in unlikely places,” not “assume that people on the other side have monolithic views” and believe that they “may share our beliefs about sticking to the rules, observing norms.” The alternative is “an increasing willingness on the part of politicians and their followers to violate democratic norms, to do anything they can to get their way, to use the power of the state to target critics and journalists and political rivals and to even resort to violence in order to gain and hold onto power,” he said. “In those circumstances, pluralism does not call for us to just stand back and save our breath,” Obama said. “In those circumstances, a line has been crossed and we have to stand firm and speak out and organize and mobilize as forcefully as we can.” But, in nodding to the fact that such change can’t happen quickly, he also called a restoration of “habits and practices that so often we’ve lost, learning to trust each other,” is “a generational project.” Illinois Gov. This milestone includes the deployment of an advanced module designed to transfer satellites to higher orbits. The mission featured the Saman-1 orbital transfer unit (OTU) and the Fakhr-1 nanosatellite, setting a new national record for payload capacity. The launch occurred at the Imam Khomeini Space Launch Terminal in southeast Semnan, where the Simorgh rocket, a two-stage liquid-fueled launcher developed by the Ministry of Defense and Armed Forces Logistics, carried approximately 300 kilograms of payloads, including the Saman-1, Fakhr-1, and a CubeSat, into an elliptical orbit with an apogee of 410 kilometers and a perigee of 300 kilometers. Developed by the Iranian Space Research Center (ISRC), the Saman-1 OTU aims to elevate satellites to higher orbits, thereby reducing costs and the dependency on larger, fuel-intensive launch vehicles. This mission represents a crucial step in advancing Iran’s space technology, facilitating more efficient satellite deployment. The Fakhr-1 nanosatellite, a 3U unit weighing under 10 kilograms, was developed by experts from the Ministry of Defense's Iran Electronics Industries, in collaboration with the Iranian Army and Malek Ashtar University of Technology. Named in honor of Dr. Mohsen Fakhrizadeh, the satellite's mission is to validate key technologies essential for CubeSat constellations, which utilize cutting-edge technology to provide unique services from low Earth orbit. Upon achieving orbit, Fakhr-1 transmitted its initial signals to ground stations, confirming its stabilization and operational status. It features indigenously developed subsystems, including a central computer, power management, radio communications, and flight dynamics, highlighting Iran's technological prowess. The Simorgh rocket achieved an impressive injection speed of 7,754 meters per second, reinforcing its status as Iran's sole launcher capable of placing such payloads into low Earth orbit (LEO). Recent satellite launches indicate that Iran is working to improve its imaging and electromagnetic spectrum monitoring capabilities for future missions, aiming to enhance its position in satellite development and launch technology. Earlier this year, Iran launched three satellites simultaneously using the Simorgh rocket, achieving new heights in its satellite deployment capabilities. Additionally, in September, the Chamran-1 research satellite was placed into a 550-kilometer orbit using the Qaem-100 satellite carrier, further demonstrating Iran's growing expertise in space technology.
In a year that has seen high-profile artists raising their voices against artificial intelligence exploiting works of art, reclusive British singer-songwriter Kate Bush is the latest to add her name to the list. As per The Guardian, the Wuthering Heights singer has called on UK ministers to protect artists from AI using their copyrighted works amid ongoing political uncertainty over how to handle the issue. Bush joins actors Julianne Moore, Kevin Bacon, Rosario Dawson, Stephen Fry and Hugh Bonneville in signing a petition, now backed by over 36,000 creatives, which states the "unlicensed use of creative works for training generative AI is a major, unjust threat to the livelihoods of the people behind those works, and must not be permitted". The latest movement against AI comes as the UK government is expected to launch a consultation into a new system which would allow copyright holders to opt out of having their work mined to train AI algorithms. However, creatives have opposed the approach on the grounds that it is too complicated to opt out from it. Instead, artists would prefer an opt-in arrangement that would allow them to be paid in exchange for algorithms being trained on their work. Bush's foray into the issue comes after Beatles legend Paul McCartney backed calls to stop mass copyright theft by generative AI companies, warning that the technology "could just take over", and that it "would be a very sad thing indeed". Meanwhile, Radiohead singer Thom Yorke and Björn Ulvaeus of Abba, have also signed the same petition as Bush. Speaking on behalf of potentially exploited artists, Ulvaeus has said, "I don't know if it's too late but certainly we have to fight for the writers of music so they can be remunerated in some form or other." The Darnold-Jefferson connection is thriving for the surging Vikings
Unrivaled, the new 3-on-3 women's basketball league launching this winter, signed LSU star guard Flau'jae Johnson to a name, image and likeness deal. Johnson is the second college player to ink an agreement with Unrivaled, following UConn's Paige Bueckers. They won't be participating in the upcoming inaugural season, but Johnson and Bueckers will have equity stakes in the league. Unrivaled dropped a video on social media Thursday showing Johnson -- who also has a burgeoning rap career -- performing a song while wearing a shirt that reads, "The Future is Unrivaled." The deal will see Johnson create additional promotional content for the league. Johnson, 21, was a freshman on the LSU team that won the 2023 national championship. Now in her junior year, Johnson is averaging career highs of 22.2 points, 6.0 rebounds and 3.3 assists per game through 10 games for the No. 5 Tigers (10-0). She ranks eighth in Division I in scoring. Johnson has career averages of 14.1 points, 5.8 rebounds and 2.3 assists per game in 82 career appearances (80 starts) for LSU. --Field Level MediaSAN DIEGO , Dec. 15, 2024 /PRNewswire/ -- Robbins Geller Rudman & Dowd LLP announces that purchasers or acquirers of ASML Holding N.V. The ASML class action lawsuit alleges that defendants throughout the Class Period made false and/or misleading statements and/or failed to disclose that: (i) the issues being faced by suppliers, like ASML, in the semiconductor industry were much more severe than defendants had indicated to investors; (ii) the pace of recovery of sales in the semiconductor industry was much slower than defendants had publicly acknowledged; and (iii) defendants had created the false impression that they possessed reliable information pertaining to customer demand and anticipated growth, while also downplaying risk from macroeconomic and industry fluctuations, as well as stronger regulations restricting the export of semiconductor technology, including the products that ASML sells. The ASML class action lawsuit further alleges that on October 15, 2024 , ASML announced that it: (i) recorded quarterly booking of only €2.63 billion – a 53% decline from €5.6 billion in the second quarter of 2024; (ii) expected full year 2025 net sales to be between €30 billion and €35 billion, in the lower half of ASML's initial range of between €30 billion and €40 billion; and (iii) materially reduced its gross margin target to between 51% and 53%, down from its prior guidance of between 54% and 56%. On this news, the price of ASML stock fell more than 16%, according to the complaint. Then, on October 16, 2024 , during the accompanying earnings call, the ASML class action lawsuit alleges that ASML's CFO, defendant Roger Dassen , attributed the poor bookings results to "a reflection of the slow recovery in the traditional [semiconductor] end markets as customers remain cautious in the current environment." Additionally, ASML's CEO, defendant Christophe Fouquet , admitted that the semiconductor industry "recovery will extend well into 2025," leading to "a reduced growth curve in 2025 and an . . . overall reduction of our lithography demand," according to the complaint. The ASML class action lawsuit alleges that on this news, the price of ASML stock fell more than 6%. How a California man dealt with freedom after he was framed for murder and locked in prison for 20 years
NEW DELHI, India (AP) — A 13-year-old cricketer from India’s northern state of Bihar could become the sport’s latest Twenty20 batting sensation. The Rajasthan Royals think so highly of Vaibhav Suryavanshi that they paid $130,000 in the Indian Premier League’s mega auction for his services, making him the youngest ever to be selected. Suryavanshi came to the limelight last month when he scored a century against Australia’s under-19 team off just 58 balls before he got out for 104. At the age of 13 years and 187 days, Suryavanshi broke the record of Bangladesh’s present test captain Najmul Hossain Shanto, who at the age of 14 years and 241 days held the previous record of scoring a century at youth level. The Delhi Capitals also showed interest when the bid for Suryavanshi started at his base price of $35,500. “He’s been to our high performance center in Nagpur, he had trials there and really impressed our coaching set-up there,” Rajasthan CEO Jake Lush McCrum said after the auction ended Monday. “He’s an incredible talent and of course you’ve got to have the confidence so he can step up to the IPL level.” McCrum described Suryavanshi as a “hell of a talent” and hoped lots of work will go into the coming months before the IPL begins on March 14 with former Indian captain Rahul Dravid among the coaching panel of the franchise. Suryavanshi idolizes legendary West Indian batter Brian Lara and often gets tips from former India batter Wasim Jaffer, with whom he met during an under-19 tournament in Bangladesh last year. Suryavanshi’s father, Sanjiv, is his coach and has worked with him since his son showed interest in the game at an early age. “He is not just my son now, but entire Bihar’s son,” the elder Suryavanshi told Press Trust of India. “My son has worked hard.” The IPL does not have a formal minimum age requirement, but in 2020 the International Cricket Council set the minimum age of 15 for players to compete internationally. However, the game’s governing body also said at that time that cricket boards can request permission to allow players under 15 to represent their country.
