Published 2:48 pm Monday, November 25, 2024 By Associated Press WASHINGTON — Special counsel Jack Smith moved to abandon two criminal cases against Donald Trump on Monday, acknowledging that Trump’s return to the White House will preclude attempts to federally prosecute him for retaining classified documents or trying to overturn his 2020 election defeat. The decision was inevitable, since longstanding Justice Department policy says sitting presidents cannot face criminal prosecution. Yet it was still a momentous finale to an unprecedented chapter in political and law enforcement history, as federal officials attempted to hold accountable a former president while he was simultaneously running for another term. In court filings, Smith’s team emphasized that the move to abandon their prosecutions was not a reflection of the merit of the cases but a recognition of the legal shield that surrounds any commander in chief. “That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind,” the prosecutors wrote in one of their filings. Smith’s team said it was leaving intact charges against two co-defendants in the classified documents case — Trump valet Walt Nauta and Mar-a-Lago property manager Carlos De Oliveira — because “no principle of temporary immunity applies to them.” Steven Cheung, Trump’s incoming White House communications director, welcomed the decision to drop the prosecutions against the president-elect, describing it as a “major victory for the rule of law.” “The American People and President Trump want an immediate end to the political weaponization of our justice system and we look forward to uniting our country,” Cheung said in a statement. Trump has long described the investigations as politically motivated, and he has vowed to fire Smith as soon as he takes office in January. Now he will re-enter the White House free from criminal scrutiny by the government that he will lead. The election case brought last year was once seen as one of the most serious legal threats facing Trump as he tried to reclaim the White House. He was indicted for plotting to overturn his defeat to Joe Biden in 2020, an effort that climaxed with his supporters’ violent attack on the U.S. Capitol on Jan. 6, 2021. But the case quickly stalled amid legal fighting over Trump’s sweeping claims of immunity from prosecution for acts he took while in the White House. The U.S. Supreme Court in July ruled for the first time that former presidents have broad immunity from prosecution, and sent the case back to U.S. District Judge Tanya Chutkan to determine which allegations in the indictment, if any, could proceed to trial. The case was just beginning to pick up steam again in the trial court in the weeks leading up to this year’s election. Smith’s team in October filed a lengthy brief laying out new evidence they planned to use against him at trial, accusing him of “resorting to crimes” in an increasingly desperate effort to overturn the will of voters after he lost to Biden. The separate case involving classified documents had been widely seen as legally clear cut, especially because the conduct in question occurred after Trump left the White House and lost the powers of the presidency. The indictment included dozens of felony counts accusing him of illegally hoarding classified records from his presidency at his Mar-a-Lago estate in Palm Beach, Florida, and obstructing federal efforts to get them back. He has pleaded not guilty and denied wrongdoing. The case quickly became snarled by delays, with U.S. District Judge Aileen Cannon slow to issue rulings — which favored Trump’s strategy of pushing off deadlines in all his criminal cases — while also entertaining defense motions and arguments that experts said other judges would have dispensed with without hearings. In May, she indefinitely canceled the trial date amid a series of unresolved legal issues before dismissing the case outright two months later. Smith’s team appealed the decision, but now has given up that effort.
Colorado U.S. Rep. Lauren Boebert broke new ground over the weekend when she became the first sitting member of Congress to offer personalized messages for sale — starting at $250 — through the video platform Cameo . The Windsor Republican, who won election to a new congressional seat this month after moving across the state, started the account Saturday. The website allows customers to buy personalized video messages from celebrities. On Monday morning, Boebert advertised her messages starting at $250, though she stopped taking requests by 10:45 a.m. mountain time. And by 5:30 p.m., her Cameo page appeared to have been shut down. Her office declined to comment Monday. “Whether you or someone you know needs an America-first pep talk, if you want to surprise friends or family with a message for a special day, or if you just want to know my thoughts on whatever’s on your mind, Cameo is the place to connect with me,” Boebert said in the introductory video posted on the now-inactive profile. Brandon Kazimer, a Cameo spokesperson, confirmed that the account belonged to Boebert. Kazimer said she was the first sitting member of Congress to sign up for the service as talent. At least two other former members of Congress, George Santos of New York and Matt Gaetz of Florida, have sold videos on the platform. Santos joined Cameo soon after he was expelled from Congress last year over allegations he exploited office for personal financial gain. Gaetz, who is a friend of Boebert’s, joined the service Friday, days after he withdrew his nomination by President-elect Donald Trump to be the U.S. attorney general following allegations that he paid a teenage girl for sex. Boebert does not appear to have advertised the service on her other social media accounts on X or Facebook. Congressional rules will limit how much Boebert can earn from the videos. In 2023, members were limited to making $31,815 in outside income beyond their annual $174,000 salaries. She would have to report any earnings from Cameo on her annual disclosures. The law also prohibits people from using their public office to make outside money, said Kedric Payne, a vice president and senior director of ethics for the Campaign Legal Center. Ultimately, the restriction is meant to give voters confidence that elected officials aren’t using public office for personal gain — or putting that gain ahead of their public service. The plunge back to South Korea's dark days of military rule only lasted a few hours, and after a night of protests and high drama Yoon was forced into a U-turn in the early hours of Wednesday. But polls show a huge majority of citizens want him out and lawmakers voted Saturday on an impeachment motion brought by the opposition, who control parliament. But even though only eight of them needed to support the motion for it to pass, all but three MPs from Yoon's People Power Party (PPP) boycotted the vote and it failed. This is despite the PPP's leader Han Dong-hoon -- allegedly on an arrest list the night of the martial law declaration -- saying Yoon's resignation was "inevitable". On Saturday before the vote, Yoon spoke publicly for the first time in days, apologising for the "anxiety and inconvenience" he caused, but stopping short of throwing in the towel. Instead the 63-year-old said he would "entrust the party with measures to stabilise the political situation, including my term in office". Born in Seoul in 1960 months before a military coup, Yoon studied law and went on to become a star public prosecutor and anti-corruption crusader. He played an instrumental role in Park Geun-hye, South Korea's first female president, being convicted of abuse of power, imprisoned and impeached in 2016. As the country's top prosecutor in 2019, he also indicted a top aide of Park's successor, Moon Jae-in, in a fraud and bribery case. The conservative PPP, in opposition at the time, liked what they saw and convinced Yoon to become their presidential candidate. He duly won in March 2022, beating Lee Jae-myung of the Democratic Party, but by the narrowest margin in South Korean history. Yoon was never much loved by the public, especially by women -- he vowed on the campaign trail to abolish the ministry of gender equality -- and scandals have come thick and fast. This included his administration's handling of a 2022 crowd crush during Halloween festivities that killed more than 150 people. Voters have also blamed Yoon's administration for food inflation, a lagging economy and increasing constraints on freedom of speech. He was accused of abusing presidential vetoes, notably to strike down a bill paving the way for a special investigation into alleged stock manipulation by his wife Kim Keon Hee. Yoon suffered further reputational damage last year when his wife was secretly filmed accepting a designer handbag worth $2,000 as a gift. Yoon insisted it would have been rude to refuse. NoneAutomakers have come under scrutiny following the release of a report by Amnesty International, which exposes widespread human rights violations within the supply chains of electric vehicle (EV) manufacturers. Among the 13 companies assessed, Chinese automaker and global leader in EVs, BYD, received the lowest score, 11 out of 90, due to its refusal to disclose critical information about their supply chain, human rights and smelting practices. But they weren’t the only automaker with a low score, Mitsubishi and Hyundai followed closely scoring 13 and 21. None of the three automakers published information about how human rights can impact battery metal sourcing. Additionally, none of the three reported mapping their supply chains or identifying risks. They also failed to respond to Amnesty’s findings. It’s a stark contrast to the top of the list, German automaker Mercedes-Benz, which scored 51. But even then, Amnesty believes a total of 68 points or more shows a level of commitment to human rights issues. The global push towards electrification means that automakers are relying heavily on minerals like cobalt, nickel and lithium, which are crucial for battery production. To put it into perspective - an EV requires six times more minerals than a conventional car and the demand could grow tenfold by 2040, according to International Energy Agency. Amnesty International secretary-general Agnes Callamard believes the rise and demand for metals required to make EV batteries is putting “immense pressure” on mining-affected communities. “The human rights abuses tied to the extraction of energy transition minerals are alarming and pervasive and the industry’s response is sorely lacking. Communities are suffering from forced evictions, health issues caused by pollution and difficulties accessing water. As demand for electric vehicles increases, manufacturers must ensure people’s human rights are respected.” she said. These minerals are essential for EV battery production but Callamard believes mining for these minerals can entail huge risks for people and the environment. “Amnesty International’s previous research has shown how industrial cobalt is linked to forced evictions in the Democratic Republic of Congo. Car companies need to use their massive leverage as global minerals buyers to influence upstream mining companies and smelters to mitigate these human rights risks.” she said. The rush to secure resource has led to consequences like child labour, forced evictions and unsafe working conditions, particularly in countries like Democratic Republic of Congo, which supplies 25 per cent of the world’s cobalt. In 2023, the Business and Human Rights Resource Centre (BHRRC) recorded a marked increase in labour violations, worker deaths and environmental harm. Out of the offenders, state owner China Minmetals topped the list. Tesla and Volkswagen have both maintained ties to the mining giants like Glencore and Minmetals despite allegations of unsafe working conditions and exploitative practices at their sites. Since 2010, BHRRC has documented 630 allegations of human rights abuses involving seven key minerals critical to EVs including cobalt, nickel and lithium. Many of these allegations are tied to the same companies that Amnesty Internal revealed in their report - BYD, Volkswagen and Tesla. Amnesty International said there has been some progress since they first drew attention to the matter in 2017, however most of the companies included in their report are not demonstrating sufficient standards of human rights. “Amnesty International is calling on all car makers to improve their human rights due diligence efforts and bring them in line with international human rights standards,” she said. “We are also calling on governments to strengthen their own human rights due diligence regulation over the companies incorporated on their territories or their exports and import licenses.”
