The lawsuit filed in state district court in Lubbock and announced Sunday, argues the NCAA violates the Texas Deceptive Trade Practices Act by promoting women’s sports that may include a transgender athlete. The law is designed to protect consumers from being misled or tricked into buying products or services that are not as advertised, the lawsuit said. The Texas lawsuit is the latest attempt by conservative politicians to target transgender athletes and push the NCAA into banning them from competition. President-elect Donald Trump has said he wants to stop trans athletes from competing . The lawsuit seeks an injunction to stop the NCAA from allowing transgender athletes to compete in women’s sports in Texas, or in sports that involve Texas programs. Or it wants the court to require the NCAA to stop marketing events as “women’s” sports if transgender athletes are allowed. In a statement, Paxton appeared to reference the recent controversy involving San Jose State women’s volleyball , where several opponents forfeited matches this season on grounds the Spartans had a transgender player. A federal court last month refused to block the school from playing in the Mountain West Conference championship. “When people watch a women’s volleyball game, for example, they expect to see women playing against other women, not biological males pretending to be something they are not,” Paxton said. “Radical ‘gender theory’ has no place in college sports.” The Associated Press is withholding the player’s name because she has not publicly commented on her gender identity and through school officials has declined an interview request. Paxton accused the NCAA of “intentionally and knowingly jeopardizing the safety and wellbeing of women” and turning women’s sports into “co-ed competitions.” The NCAA does not track data on transgender athletes among the 544,000 currently competing on 19,000 teams at various levels across the country. NCAA President Charlie Baker testified in Congress earlier this month that he was aware of fewer than 10 active NCAA athletes who identified as transgender. “College sports are the premier stage for women’s sports in America, and while the NCAA does not comment on pending litigation, the Association and its members will continue to promote Title IX, make unprecedented investments in women’s sports and ensure fair competition in all NCAA championships,” the NCAA said in a statement Monday. Brooke Slusser, the San Jose State volleyball co-captain who was among the group of players who sued the Mountain West Conference over her teammate’s participation, praised the Texas lawsuit on social media. “Hey NCAA, just in case you haven’t realized yet this fight will just keep getting harder for you until you make a change!,” Slusser posted on X . The NCAA established a policy in 2010 that requires trans athletes who were assigned male at birth to complete at least one year of testosterone suppression therapy before being eligible to compete on a women’s team. Trans athletes who were assigned female at birth and transitioned to male can compete on a men’s team but if they have received testosterone treatment are ineligible to compete on a women’s team. The athletes are required to meet their chosen sport’s standard for documented testosterone levels at various points during a season. In 2022, the NCAA revised the policy in what the organization called an attempt to be aligned with national sports governing bodies. If a governing body does not have a trans athlete policy, then it scales up to the international federation that oversees the sport. If there is no international federation policy, previously established Olympic policy criteria would be followed.

Canadian telecommunications firms are monitoring their networks for signs that they may have been targeted as part of a global cyberespionage campaign from China. A group of hackers known as Salt Typhoon is being blamed for the sprawling cybersecurity attack that gave Beijing access to the calls and texts of a number of top U.S. officials, including president-elect Donald Trump and vice-president-elect J.D. Vance. There is no indication thus far Canadian networks have also been breached by the campaign, which has dominated headlines for weeks. But experts say the networks contain the same vulnerabilities as those in the U.S., which should serve as a wake-up call to address them. Cyberattacks against Canadian critical infrastructure have become more numerous and sophisticated in recent years. The White House has said that the Salt Typhoon attack, which was perpetrated for a year or more by exploiting legacy telecom equipment, has affected at least eight U.S. telecoms and dozens of countries around the world. China has dismissed the allegations as disinformation. Madeline Deyo, a spokesperson the Canadian Centre for Cyber Security, part of the federal cryptologic agency, said in an e-mail Tuesday that it was “not aware of any Canadian networks impacted by this activity,” but had engaged directly with Canadian service providers to help contextualize the nature and significance of the threat posed by the Salt Typhoon hacking campaign. In late October, the Cyber Centre said it was aware that a sophisticated state-sponsored threat actor from China had performed reconnaissance scanning over several months against numerous organizations and government agencies. It listed critical infrastructure providers among the targets. Rogers Communications Inc., RCI-B-T BCE Inc.’s Bell, BCE-T Telus Corp. T-T and SaskTel told The Globe and Mail that they are aware of the reported surveillance affecting telecom providers in the U.S., and are actively working with industry peers and government to remain vigilant against attacks. Cogeco Inc. CGO-T and Bragg Communications Inc.’s Eastlink said they are monitoring the situation. Of these providers, Rogers, Bell and Cogeco said they have not observed any evidence of malicious activity on its networks. Quebecor QBR-B-T did not respond to requests for comment. Yet numerous experts say the full extent of the breach – and its effects on Canada – have likely not yet been discovered. “There’s no reason to think that somehow Canada would be immune from this kind of attack,” said Charles Finlay, executive director of Rogers Cybersecure Catalyst at Toronto Metropolitan University. Canada is particularly vulnerable given the interconnectedness of the telecommunications systems with the United States, he said. Canadian telecoms should be alert given that they generally use similar infrastructure – in particular, core routers and network devices – to what is used by the affected U.S. companies, said Gary Miller, a threat intelligence expert and researcher with the University of Toronto’s Citizen Lab. While the U.S. government did not identify a particular company’s equipment as being the entry point for Salt Typhoon, it published last Tuesday specific security guidance for Cisco Systems Inc. products, which are broadly used by Canadian telecoms as well, Mr. Miller said. Moreover, finding evidence of attacks or surveillance takes time, he added. While Canadian telecoms have traditionally been alert to threats entering through cracks in the edge of their networks where it interconnects with other providers, he said, they have not been as quick to identify threats once they’re already inside. There are varying reports about how long the attackers had been inside the networks, with the White House suggesting the infiltration could have been continuing for as long as two years. The fact that different information about the length of the attack is emerging suggests its full breadth is still unknown, said Bryan Pollitt, an EY Canada telecommunications cybersecurity expert. “I don’t think we yet know the full scope of the affected organizations – we’re just learning,” he said. Meanwhile, telecoms and lawmakers shouldn’t discount the recent history of geopolitical tensions with China that may make Canada a target for telecom interference, experts said. Canada has been critical of China’s human-rights record, approach to Hong Kong and Taiwan, and interference in Canadian elections. Ottawa recently imposed new surtaxes on Chinese-made electric vehicles and certain metal imports, and said it is mulling further surtaxes. “Canada has been on the receiving end of negative rhetoric from Chinese-linked actors over the past few years, and it would be naive to think of any such public statements as empty threats,” said Claudiu Popa, president of Datarisk Canada, a Toronto-based cybersecurity firm. In response to the attacks in the U.S., experts are warning Canadian lawmakers about vulnerabilities in this country’s networks. Kate Robertson, a senior researcher at the Citizen Lab, is concerned that a bill currently before Parliament – Bill C-26 – contemplates allowing Ottawa to impose compromise points in next-generation technology, such as 5G networks, to enable government surveillance. By requiring those legal access points, she said, Canada’s networks could be more vulnerable to future attacks. “The attack that is unfolding in the United States is a reflection of historical and continuing vulnerabilities in the mobile communication networks around the world,” Ms. Robertson said. And Mr. Miller said global telecom regulators, including the Canadian Radio-television and Telecommunications Commission, should take a more active role in requiring cybersecurity measures for the industry. While telecom companies have security systems – such as firewalls – in place, they don’t go far enough to protect all aspects of the network, such as protocols that interconnect different operators, he said. And telecoms may be hesitant to go to the furthest lengths possible of their own accord because of the high costs. In an e-mail, the CRTC told The Globe that the Salt Typhoon attacks fall outside its scope. While 5G promises improved security, EY’s Mr. Pollitt cautioned against treating it as a silver bullet. “We need to be mindful that a well-financed, organized, persistent group is going to find a way in and will infiltrate even the best defences,” he said.Cathie Wood is the head of money management firm Ark Invest and is best known on Wall Street for her bullish stances on emerging technologies in artificial intelligence (AI) and genomics. I'm going to explore a new partnership that Archer recently formed and outline why this particular deal could serve as a major tailwind for the company as President-elect Donald Trump and his administration assume power in Washington. Archer's stealthy opportunity For much of its history, Archer has been seen as a potential airborne alternative to traditional ride-hailing services such as Uber or Lyft . Unlike premium services offered by the likes of Blade Air Mobility , Archer's primary use case has been focused on decongesting areas that experience abnormally high levels of traffic (i.e., cities) by offering an alternative platform to taxis or subways. However, in this video, Archer Chief Executive Officer Adam Goldstein explains an under-the-radar opportunity for the company in the public sector. Why Archer could soar under President-elect Trump As part of Archer's defense ambitions, the company partnered with autonomous systems company Anduril . Anduril is the brainchild of Palmer Luckey, a serial entrepreneur most famous for selling his virtual reality start-up, Oculus, to Meta Platforms . Anduril develops a series of new-age rockets and drone technologies. I think the partnership between Anduril and Archer makes a lot of sense, given the overlap these companies have in the aviation sector. What makes Archer a particularly nice fit with Anduril is that the company's eVTOL aircraft emit very little sound, making them an attractive vehicle choice during military stealth operations. And while such an opportunity in the public sector may seem niche, keep in mind that the estimated market for stealth operations and military robotics is expected to reach more than $100 billion by early next decade. When speaking about the incoming administration, Goldstein said he thinks Trump could be "very positive" and a "big benefit" to companies such as Archer as it pertains to regulatory approvals needed to further commercialize the business, as well as get more involved with public sector operations. Is Archer stock a buy right now? One of the hardest things to do in investing is making the distinction between a real business and an alluring narrative. I see Archer as smack in the middle of this divide. Although the opportunities for Archer are intriguing, the company is in a pre-revenue state. And although it's signed billions of dollars worth of purchase orders, the company has not yet scaled. Could Trump pave the way for more streamlined regulatory frameworks and speed up Archer's commercialization timeline? Maybe, but it's not entirely known yet if an issue like this is anywhere near the top of the priority list for the new administration. Moreover, while Archer's use cases in the public sector make a lot of sense, it could be years before its aircraft are used anywhere. I am curious and ever-so-slightly cautiously optimistic that Archer could emerge as a winner during the next four years. However, I think an investment in Archer is best for those who can afford a small allocation in their portfolio for speculative opportunities. If that type of risk is too much for you, I'd encourage you to move on and identify more mature opportunities in the EV or defense sectors.

Before his death today, Jimmy Carter defied illness and death for years. When his melanoma spread to his brain in 2015, he drew praise for announcing it publicly. Even as he underwent treatment, he continued to teach Sunday school in his home town's Baptist church. Within months, he announced that he was cancer-free. Four years later, Carter fell at least three times, at one point breaking a hip and at another requiring 14 stitches. Each time he bounced back, even showing up for a Habitat for Humanity home-building project shortly after one stumble. But he has slowly retreated from public life lately, making fewer and fewer appearances or statements and was unable to attend President Biden's inauguration in January 2021. However, he lived long enough to outlast two presidents who followed him and his own vice president, Walter Mondale. He became the longest-living president in March 2019 when he passed former President George H.W. Bush, who died four months before. Although Carter, nicknamed Jimmy Cardigan after once wearing a jumper for a televised speech, left the White House after one of the biggest landslide defeats of the modern era, he was one of very few US leaders to be memorialised while still alive. The evolution of his legacy was unusual as he had such a long period between the end of his unpopular presidency and the announcement at the weekend that he would undergo no further treatment to die peacefully at his home. Carter's time in the White House was marred by his struggles to respond to formidable challenges, including a major energy crisis, high inflation, and unemployment. He took office after Gerald Ford left the entire US government in disarray. Carter entered the Oval Office facing mounting challenges - an energy crisis, Soviet aggression and, above all, a deep mistrust of leadership by voters. In foreign affairs, he reopened US relations with China and tried to broker peace in the historic Arab-Israeli conflict, but was damaged late in his term by a hostage crisis in Iran. Carter's diagnosis of America's "crisis of confidence" did little to boost his flagging popularity, and in 1980 he was defeated in the general election by Ronald Reagan. Over the following decades, Carter built a distinguished career as a diplomat, humanitarian and author, pursuing conflict resolution in countries around the globe. He was awarded the Noble Peace Prize in 2002 "for his decades of untiring effort to find peaceful solutions to international conflicts, to advance democracy and human rights, and to promote economic and social development." Born in Plains, Georgia, in October 1924, Carter attended the US Naval Academy graduating in 1946. Already, he had a solid moral compass installed in him by his nurse mother, "Miz" Lillian. She set an example for her son by crossing the strict lines of segregation in 1920s Georgia to counsel poor African American women on health care. Shortly after passing out of the navy, he married Rosalynn Smith, having four children together. But tragedy struck in July 1953 as while he was preparing to serve as an engineering officer on the submarine Seawolf, his father, Earl, died from cancer. Carter returned home and was able to rebuild his family's struggling peanut warehouse business after a crippling drought. Ironically the legume became the symbol of his presidential campaign. Active in community affairs and a deacon at the Plains Baptist Church, he launched his political career with a seat on his local board of education. In 1962, he won the election to the Georgia State Senate as a Democrat, running for the governor's office four years later, finishing a disappointing third. The loss sent Carter into a depression, which he overcame by finding renewed faith as a born-again Christian. He ran again for the governorship in 1970 and won. A year later, Carter was featured on the cover of Time magazine as one of a new breed of young political leaders in the South, known for their moderate racial views and progressive economic and social policies. Initially, Carter was a political phenomenon, a new-generation Democrat who, after a single term as governor of the Peach State, shocked the political world by beating a host of better-known rivals to capture his party's presidential nomination in 1976. A year later, he would oust the incumbent Republican president, Ford. Over four years in office, he sought to restore trust in government following the Vietnam War and the Watergate scandal, ushering in reforms meant to transform politics. He mediated the historic Camp David Accords, making peace between Israel and Egypt, an agreement that remains the foundation of Middle East relations. But a sour economy, rocketing inflation, and a 444-day hostage crisis in Iran where 52 American diplomats were held captive undercut his public support. Ultimately, it cost him his re-election bid, losing to Ronald Reagan in 1980. Carter spent his post-presidency, however, on a series of philanthropic causes around the world, like building houses for the poor, combating disease, promoting human rights in places of repression, monitoring elections and seeking to end conflicts. His work as a former president in many ways came to eclipse his time in the White House, eventually earning him the Nobel Peace Prize and rehabilitating his image in the eyes of many Americans. "Between the time he left office and entered hospice care, he got to sit back and enjoy the adulation of a grateful nation," Jeffrey Engel, the director for the presidential history centre at Southern Methodist University, said. "The passage of time smoothed out the rough edges of his political career. If Carter had died in 1982, there would be less adulation than he is receiving right now." Joseph Crespino, the Jimmy Carter Professor of History at Emory University, called his resilience "remarkable." "Instead of sulking about not winning the second term, he used his influence and prominence from his position in politics to help millions of people and win the Nobel Peace Prize," he said. When asked about regrets, Carter spoke of his in his autobiography "A Full Life: Reflections at Ninety." The former president said he was upset by how his kiss with the Queen Mother was portrayed. He wrote how he didn't regret puckering up to Her Majesty, describing it as "lightly on the cheek" as the pair said goodnight after dinner at Buckingham Place in May 1977. However, much like his presidency, its impact never left those affected most by his actions.
